Procedure for Converting Construction Survey Practice Certificates

Legal Basis: - Construction Law 2014; Decree 15/2021/ND-CP; Decree 100/2018/ND-CP; Circular 38/2022/TT-BTC; Amended Construction Law 2020.

According to the current legal regulations, foreign individuals or Vietnamese residing abroad who have obtained a construction surveying practice certificate issued by a foreign agency or organization, if practicing construction surveying in Vietnam for less than 06 months, are recognized for practice. In cases where individuals practice construction surveying in Vietnam for 06 months or more, they must convert their construction surveying practice certificate at a competent authority following legal regulations.

The process and procedures for converting a Construction Surveying Practice Certificate are specifically implemented as follows:

1. Conditions for conversion:

Foreign individuals or Vietnamese residing abroad who have obtained a construction surveying practice certificate issued by a foreign agency or organization, if practicing construction surveying in Vietnam for 06 months or more, must convert their construction surveying practice certificate at a competent authority following legal regulations.

2. Application for conversion:

Includes:

- An application for the conversion of a construction surveying practice certificate, 02 color photos of 4 x 6 cm size with a white background of the applicant taken within the last 06 months;

- A copy of the education degree and construction surveying practice certificate issued by a foreign agency or organization that has been consular legalized, translated into Vietnamese, and notarized or certified according to Vietnamese law;

- A certified copy or a file containing color photos taken from the original or copy, presenting the original for comparison of legal documents on residence or work permit issued by a competent authority in Vietnam per regulations.

3. Conversion process:

- Individuals submit 01 set of applications for the conversion of the Construction Surveying Practice Certificate online, by post, or directly at the competent authority responsible for issuing the Construction Surveying Practice Certificate.

- Within 25 days from the date of receipt of a complete and valid application, the competent authority is responsible for issuing the Construction Surveying Practice Certificate;

Note: In cases where the application is incomplete or invalid, the competent authority must notify the applicant in writing within 05 days from the date of receipt of the application.

4. Authority for conversion:

- Grade I: Specialized construction agency under the Ministry of Construction.

- Grades II and III: Department of Construction; or a recognized professional social organization qualified to issue construction activity practice certificates to its members.

5. Time limit for resolution: 25 days from the date of receipt of a complete and valid application.

6. Conversion fee: 150,000 (One hundred and fifty thousand) VND/certificate.

7. Validity period of the Certificate: Validity is determined according to the duration stated in the work permit or temporary residence card issued by the competent authority but not exceeding 05 years.
