Procedure for Conversion of Construction Supervision Practice Certificates

Legal Basis: - Construction Law 2014; Decree 15/2021/ND-CP; Decree 100/2018/ND-CP; Circular 38/2022/TT-BTC; Amended Construction Law 2020.

According to the current legal provisions, foreign individuals or overseas Vietnamese who hold a construction supervision practice certificate issued by a foreign agency or organization, if practicing construction supervision in Vietnam for less than 06 months, are recognized to practice. In case an individual practices construction supervision in Vietnam for 06 months or more, the construction supervision practice certificate must be converted at the competent authority issuing the practice certificate according to the provisions of law.

The procedure for converting the Construction Supervision Practice Certificate is specifically as follows:

1. Conditions for converting the Construction Supervision Practice Certificate

Foreign individuals or overseas Vietnamese who have a construction supervision practice certificate issued by a foreign agency or organization, if practicing construction supervision in Vietnam for 06 months or more, must convert the construction supervision practice certificate at the competent authority issuing the practice certificate according to the provisions of law.

2. Dossier for converting the contents of the Construction Supervision Practice Certificate

The application dossier includes:

- An application form for converting the construction supervision practice certificate, 02 colored photos sized 4 x 6 cm with a white background portrait of the applicant taken within the last 06 months;

- A copy of the training diploma, construction supervision practice certificate issued by a foreign agency or organization that has been consular legalized, translated into Vietnamese, and notarized, authenticated according to the regulations of Vietnamese law;

- A certified copy or a file containing color photos taken from the original or a copy, presenting the original for comparison with legal documents on residence or work permits issued by competent Vietnamese authorities according to the regulations.

3. Process for converting the Construction Supervision Practice Certificate

- Individuals submit 01 set of application dossier for converting the Construction Supervision Practice Certificate online, by post, or directly at the competent authority issuing the Construction Survey Practice Certificate.

- Within 25 days from the date of receiving a complete and valid dossier, the competent authority is responsible for issuing the Construction Supervision Practice Certificate;

Note: If the dossier is incomplete or invalid, the competent authority issuing the Construction Supervision Practice Certificate must notify the individual applying for conversion in writing within 05 days from the date of receiving the application dossier.

4. Authority for converting the Construction Supervision Practice Certificate

- Class I: Construction professional agency under the Ministry of Construction.

- Class II, Class III: Department of Construction; Or a recognized social-professional organization that is eligible to issue the Construction Practice Certificate for its members or affiliates.

5. Processing time: 25 days from the date of receiving a complete and valid dossier.

6. Fee for converting the Construction Supervision Practice Certificate: 150,000 VND (One hundred fifty thousand) per certificate.

7. Validity of the Construction Supervision Practice Certificate: The validity is determined according to the term stated in the work permit or temporary residence card issued by the competent authority but not exceeding 05 years.
