Procedure for Conversion of Construction Planning Design Practice Certificate

Legal Basis:

- Law on Construction 2014;- Decree 15/2021/ND-CP;- Decree 100/2018/ND-CP;- Circular 38/2022/TT-BTC;- Amended Law on Construction 2020.

According to the current legal provisions, foreign individuals or Vietnamese residing abroad who possess a practicing certificate in construction planning design issued by a foreign agency or organization, if practicing construction planning design in Vietnam for less than 06 months, are recognized for practicing. In case an individual practices construction planning design in Vietnam for 06 months or more, he/she must convert the practicing certificate at the competent authority according to the law.

The specific procedure for converting the Construction Planning Design Practicing Certificate is as follows:

1. Conditions for conversion:

Foreign individuals or Vietnamese residing abroad who have a practicing certificate in construction planning design issued by a foreign agency or organization, if practicing construction planning design in Vietnam for 06 months or more, must convert the practicing certificate at the competent authority according to the law.

2. Dossier for conversion:

Include:

- Application form for converting the construction planning design practicing certificate, 02 color photos size 4 x 6 cm with a white background portrait of the applicant taken within the last 06 months;

- A copy of the degree, the practicing certificate in construction planning design issued by a foreign agency or organization, legalized, translated into Vietnamese, and notarized, authenticated as per Vietnamese law;

- A certified copy or a file containing a color photo taken from the original or a copy presented together with the original for comparison of legal residence documents or work permits issued by a competent Vietnamese authority as per regulations.

3. Conversion process:

- Individuals shall send 01 set of documents requesting the conversion of the Construction Planning Design Practicing Certificate via online, postal service, or directly to the competent authority issuing the Construction Planning Design Practicing Certificate.

- Within 25 days from the date of receipt of a complete and valid dossier, the competent authority shall issue the Construction Planning Design Practicing Certificate;

Note: In case the dossier is incomplete or not valid, the competent authority issuing the Construction Planning Design Practicing Certificate must notify once in writing to the individual requesting the conversion within 05 days from the date of receipt of the application.

4. Authority for conversion:

- Grade I: Specialized construction agency under the Ministry of Construction.

- Grade II and Grade III: Department of Construction; or a recognized professional-social organization qualified to issue the Construction Practicing Certificate to its members.

5. Processing time: 25 days from the date of receipt of a complete and valid dossier.

6. Conversion fee: 150,000 VND (One hundred fifty thousand) per certificate.

7. Validity of the Construction Planning Design Practicing Certificate: The validity shall be determined according to the duration stated in the work permit or temporary residence card issued by the competent authority, but not exceeding 05 years.
