Procedure for Adjustment and Supplementation of Content of Building Planning Design Practice Certificate
Legal Basis:- Law on Construction 2014;- Decree 15/2021/ND-CP;- Decree 100/2018/ND-CP;- Circular 38/2022/TT-BTC;- Amended Law on Construction 2020.
According to existing legal regulations, the Certificate of Practice in Construction Planning Design is divided into the following categories: Class I Certificate of Practice in Construction Planning Design, Class II Certificate of Practice in Construction Planning Design, and Class III Certificate of Practice in Construction Planning Design.
Individuals who have been granted a Certificate of Practice in Construction Planning Design and wish to adjust or supplement the content of the Certificate shall be adjusted or supplemented by the competent state agency according to legal regulations.
Procedures for adjusting and supplementing the Certificate of Practice in Construction Planning Design are as follows:
1. Conditions for adjustment or supplementation:
Individuals who have been granted a Certificate of Practice in Construction Planning Design can have the content of the Certificate adjusted or supplemented upon request.
2. Dossier for adjustment or supplementation:
Includes:
- Application for the issuance of the Certificate of Practice in Construction Planning Design;- Related documents to the adjustment or supplementation requested;- 02 color photos size 4 x 6 cm with a white background taken within the last 06 months;
3. Process for adjustment or supplementation:
- Individuals submit 01 set of application documents for adjusting or supplementing the content of the Certificate of Practice in Construction Planning Design online, by mail, or directly at the competent authority issuing the Certificate of Practice in Construction Planning Design.- Within 20 days from the date of receiving a complete and valid application, the competent authority is responsible for issuing the Certificate of Practice in Construction Planning Design;
Note: In case the dossier is incomplete or invalid, the competent authority must notify in writing to the individual requesting the adjustment or supplementation of the Certificate content within 05 days from the date of receiving the dossier.
4. Competence to adjust or supplement:
- Class I: Issued by the specialized construction agency under the Ministry of Construction.- Class II, Class III: Issued by the Department of Construction; or professional social organizations recognized as qualified to issue Construction Practice Certificates for individuals who are their members.
5. Processing time: 20 days from the date of receiving a complete and valid application.
6. Fee for adjustment or supplementation: 150,000 VND (One hundred and fifty thousand dong)/certificate.
7. Validity period of the Certificate: 05 years.
Note: For certificates of foreign individuals, the validity period is determined according to the duration stated in the work permit or temporary residence card issued by the competent authority but not exceeding 05 years.
