Procedure for Adjustment and Supplementation of Construction Project Design Practice Certificate Content
Legal Basis:- Law on Construction 2014;- Decree 15/2021/ND-CP;- Decree 100/2018/ND-CP;- Circular 38/2022/TT-BTC;- Amended Law on Construction 2020.
According to current legal regulations, the Professional Practice Certificate in Construction Design is classified into the following types: Class I Professional Practice Certificate in Construction Design, Class II Professional Practice Certificate in Construction Design, and Class III Professional Practice Certificate in Construction Design.
Individuals who have been issued a Professional Practice Certificate in Construction Design and wish to have the content of their certificate modified or supplemented are entitled to have the content modified or supplemented by the competent state authority in accordance with legal regulations.
Procedure for modifying and supplementing the Professional Practice Certificate in Construction Design is specifically as follows:
1. Conditions for modifying and supplementing the Professional Practice Certificate in Construction Design
Individuals who have been issued a Professional Practice Certificate in Construction Design may have the content of their certificate modified or supplemented upon request.
2. Dossier for modifying and supplementing the Professional Practice Certificate in Construction Design
The application dossier includes:
- Application form for the Professional Practice Certificate in Construction Design;- Relevant documents related to the request for modification or supplementation;- 02 color photos size 4 x 6 cm with white background, portrait taken within the last 06 months;
3. Procedure for modifying and supplementing the Professional Practice Certificate in Construction Design
- Individuals submit 01 set of the application dossier for modifying or supplementing the Professional Practice Certificate in Construction Design online, by mail, or directly at the competent authority issuing the Professional Practice Certificate in Construction Design.- Within 20 days from the date of receiving a complete and valid dossier, the competent authority is responsible for issuing the Professional Practice Certificate in Construction Design;
Note: In cases where the dossier is incomplete or invalid, the competent authority issuing the Professional Practice Certificate in Construction Design must notify the individual requesting the modification or supplementation of the certificate content once in writing within 05 days from the date of receiving the application dossier.
4. Authority to modify and supplement the Professional Practice Certificate in Construction Design
- Class I: Issued by the specialized construction agency under the Ministry of Construction.
- Class II, Class III: Issued by the Department of Construction; or a recognized social-professional organization qualified to issue the Professional Practice Certificate in construction activities to its members or affiliates.
5. Time limit for settlement: 20 days from the date of receiving a complete and valid dossier.
6. Fee for modifying and supplementing the Professional Practice Certificate in Construction Design: 150,000 (One hundred fifty thousand) VND per certificate.
7. Validity period of the Professional Practice Certificate in Construction Design: 05 years.
Note: For the professional practice certificates of foreign individuals, the validity is determined by the term mentioned in the work permit or temporary residence card issued by the competent authority, but not exceeding 05 years.
