Procedure for Adjusting and Supplementing the Content of the Construction Supervision Practice Certificate
Legal Basis: - Construction Law 2014; Decree 15/2021/ND-CP; Decree 100/2018/ND-CP; Circular 38/2022/TT-BTC; Amended Construction Law 2020.
In accordance with current legal provisions, the Construction Supervision Practice Certificates are classified into the following categories: Category I Construction Supervision Practice Certificate, Category II Construction Supervision Practice Certificate, and Category III Construction Supervision Practice Certificate.
Individuals who have been issued a Construction Supervision Practice Certificate and seek to amend or supplement the content of the certificate may have the content amended or supplemented by the competent state authority in accordance with legal provisions.
Procedure for Amending and Supplementing the Construction Supervision Practice Certificate are as follows:
1. Conditions for Amendment and Supplement:
An individual who has been issued a Construction Supervision Practice Certificate may have its content amended or supplemented upon request.
2. Required Dossier for Amendment and Supplement:
Including:
- Application form for the issuance of the Construction Supervision Practice Certificate;- Documents related to the requested amendments or supplements;- 02 color photos sized 4 x 6 cm with a white background, taken within the last 06 months;
3. Amendment and Supplement Process:
- The individual submits 01 dossier for the amendment and supplement of the Construction Supervision Practice Certificate via online platforms, by postal service, or directly at the competent authority issuing the Construction Supervision Practice Certificate.- Within 20 days from the receipt of a complete and valid dossier, the competent authority is responsible for issuing the Construction Supervision Practice Certificate;
Note: In cases where the dossier is incomplete or invalid, the competent authority must notify the applicant once in writing within 05 days from the receipt of the dossier.
4. Authority for Amendment and Supplement:
- Category I: Issued by the construction specialized agency under the Ministry of Construction.
- Categories II and III: Issued by the Department of Construction; or a recognized professional and social organization qualified to issue the Construction Practice Certificate to its members.
5. Resolution Time: 20 days from the receipt of a complete and valid dossier.
6. Amendment and Supplement Fee: 150,000 VND (One hundred fifty thousand) per certificate.
7. Certificate Validity Period: 05 years.
Note: For the practice certificates issued to foreigners, the validity period is determined according to the term stated in the work permit or temporary residence card issued by the competent authority, but not exceeding 05 years.
