Mixed package with a value of 1.2 billion - Which bidding method to apply?

Based on Article 63 of Decree 63/2014/ND-CP on the regulations for small-scale packages, it states that mixed packages valued at no more than VND 20 billion are considered small-scale packages.

Therefore, according to Clause 1, Article 64 of Decree 63/2014/ND-CP, the process for selecting contractors for small-scale packages is conducted in accordance with Section 1, Chapter II, and Chapter V of this Decree. Consequently:

Regarding the method of selecting contractors: it will be carried out using a one-stage, one-envelope method.

As for the form of selecting contractors, one of the following forms will be chosen: direct contracting, competitive offering, direct procurement, self-implementation.

Additionally, according to Decree 63/2014/ND-CP, it stipulates the conditions for selection forms for small-scale contractors. Specifically:

Direct Contracting: The package has a value within the limit applied for direct contracting as prescribed at Point e, Clause 1, Article 22 of the Law on Procurement, including:

+ No more than VND 500 million for consulting services, non-consulting services, public services packages; no more than VND 1 billion for goods procurement, construction, mixed, medical supplies procurement, public products packages;

+ No more than VND 100 million for packages under the regular procurement estimates.

- Competitive Offering.

Applies to the following packages:

+ Simple, common non-consulting service packages;

+ Common goods procurement packages, readily available on the market with standardized technical characteristics and equivalent quality;

+ Simple construction packages with approved detailed construction designs.

The package value is under VND 5 billion.

However, according to Clause 23, Article 5 of the 2013 Law on Procurement, a mixed package is defined as a package that includes design and supply of goods (EP); design and construction (EC); supply of goods and construction (PC); design, supply of goods, and construction (EPC); project preparation, design, supply of goods, and construction (turnkey).

- Direct Procurement. (No specified conditions for application)

Therefore, for a mixed package valued at VND 1.2 billion, the procurement method will be the goods procurement method using a one-envelope method.

As for the form of selecting the contractor, you may choose one of the following forms: competitive offering, direct procurement, self-implementation.
