Promulgation of the Circular guiding the provision and posting of information on contractor selection and bidding dossier templates on the National Bidding Network System?
On April 26, 2024, the Minister of Planning and Investment issued Circular 06/2024/TT-BKHDT guiding the provision and posting of information on contractor selection and bidding dossier templates, including:
- Templates for preparation, appraisal, and approval of the master plan for contractor selection, contractor selection plans for projects, and procurement estimates according to regulations.
- Bidding dossiers templates on the National Bidding Network System for consultancy services, non-consultancy services, goods (excluding drugs), and construction packages under the scope of the Bidding Law, organized through open bidding, limited bidding, and competitive quotation within the country, using the one-stage one-envelope or one-stage two-envelope method.

When is the information on the master plan for contractor selection posted on the System?
Based on Clause 1, Article 12 of Circular 06/2024/TT-BKHDT, information about the project, master plan for contractor selection, and contractor selection plans is regulated as follows:

- Posting Time:
Information about the master plan for contractor selection and contractor selection plans is posted by the investor on the System as regulated at Point a, Clause 1 and Clause 4, Article 8 of the Bidding Law, and Clause 6, Article 14 of Decree No. 24/2024/ND-CP.
- When posting the master plan for contractor selection, the investor attaches documents serving as the basis for preparing the master plan for contractor selection as regulated at Clause 2, Article 14 of Decree No. 24/2024/ND-CP.

Based on Point a, Clause 1; Clause 4, Article 8 of the Bidding Law 2023 regulating the provision and posting of information on bidding:

- Responsibilities for posting information about contractor selection are regulated as follows:
a) The investor is responsible for posting information regulated at Points a, g, h, i, and k, Clause 1, Article 7 of this Law;
...
- Information regulated at Points a, d, g, h, i, Clause 1, and Points a, d, dd, e, Clause 2, Article 7 of this Law must be posted on the National Bidding Network System within 5 working days from the date the document is issued or the contract takes effect.
Based on Clause 6, Article 14 of Decree 24/2024/ND-CP regulating the preparation, submission, appraisal, and approval of the master plan for contractor selection for the project:

- The investor is responsible for posting the master plan for contractor selection on the National Bidding Network System within 5 working days from the date the document is issued.
Thus, the investor must post information about the master plan for contractor selection on the National Bidding Network System within 5 working days from the date the master plan for contractor selection is issued.
Additionally, the investor must attach the decision approving the master plan for contractor selection during the process of posting the master plan for contractor selection and contractor selection plans.
What are the main contents of the master plan for contractor selection?
Based on Article 36 of the Bidding Law 2023 regulating the master plan for contractor selection for the project:
Master plan for contractor selection for the project
Depending on the scale and nature of the project's bidding work, the investor or the project preparation agency might propose for the competent authority to consider and decide on the organization, preparation, and approval of the master plan for contractor selection.
The master plan for contractor selection is prepared either concurrently or independently with the feasibility study report and approved after the feasibility study report is approved.
The master plan for contractor selection includes the following essential contents:
a) Reviewing the project's implementation context in terms of bidding work;
b) Assessing the capacity, resources, and experience of the investor in implementing the project's bidding activities;
c) Analyzing the market and identifying risks in bidding;
d) Specific objectives of the bidding activities;
dd) Proposing the master plan for contractor selection for the project, including: dividing the project into bidding packages; forms and methods of contractor selection; types of contracts, principles of division and risk management; implementation schedules of key tasks and bidding packages; other contents to note in preparing bidding documents and managing contract implementation.
