Is the Procurement Package for Purchase of Goods Eligible for General Competitive Quotation?
Clause 1, Article 23 of the Bidding Law 2013 stipulates that competitive bidding is applied to packages with a value within the limit as prescribed by the Government of Vietnam and belongs to one of the following cases:
- Common, simple non-consulting service packages;
- Procurement packages for common goods, available on the market with standardized and equivalent technical characteristics in terms of quality;
- Simple construction packages that have an approved construction drawing design.
According to Article 57 of Decree 63/2014/ND-CP, the scope of application for competitive bidding is as follows:
- Competitive bidding according to the usual process is applied to packages specified in Clause 1, Article 23 of the Bidding Law with a value not exceeding 5 billion VND.
- Competitive bidding according to the simplified process is applied to packages specified at Point a, Clause 1, Article 23 of the Bidding Law with a value not exceeding 500 million VND, packages specified at Points b and c, Clause 1, Article 23 of the Bidding Law with a value not exceeding 1 billion VND, and packages for regular procurement with a value not exceeding 200 million VND.
Due to the information you provided not being specific, if the package for common goods procurement has a value not exceeding 5 billion VND, competitive bidding according to the usual process can be applied.
Competitive bidding is conducted when the following conditions are met:
- An approved plan for selecting contractors; *
- An approved budget as per regulations; *
- Funding has been allocated according to the required progress of the package implementation. *
