Is Rice Export a Conditional Business Sector?
What are the industries and trades with conditional investment and business? Is there a list? If so, where is it regulated? Please help me look up if rice export is a conditional business sector.
You can refer to the statutory regulations for conditional investment and business sectors, which are typically outlined in legal documents such as:- Law on Investment No. 61/2020/QH14 dated June 17, 2020:- This law details the conditional business sectors and includes an annex of conditional business and investment fields.
- Decree No. 31/2021/ND-CP dated March 26, 2021, detailing and guiding the implementation of several articles of the Law on Investment:- Further explanatory notes and detailed list of conditional business sectors can be found in this decree.
Pursuant to Clauses 1, 2 Article 7 of the Investment Law 2014 stipulating:
Conditional investment business lines are the lines of business in which the conduct of investment business activities in those lines must meet conditions for reasons of national defense, national security, social order, social safety, social ethics, and public health.
The list of conditional investment business lines is stipulated in Appendix 4 of this Law.
Thus, the list of conditional investment business lines is stipulated in Appendix 4 of the Investment Law 2014.
However, currently, this Appendix is replaced by Clause 2 Article 1 of the Law amending and supplementing Article 6 and Appendix 4 on the List of conditional investment business lines of the Investment Law 2016.
Based on No. 55 of this new Appendix, rice export falls under the list, hence rice export is a conditional investment business line.
Respectfully!
