Is Bringing Your Partner to a Hotel a Legal Violation?
According to the provisions of Clause 2, Article 44, Decree No. 96/2016/ND-CP, it stipulates as follows:
Responsibility of accommodation service establishments
- Verify the identity documents of guests staying, including one of the following types of documents: Identity Card; Citizen Identification; Passport; Permanent Residence Card or Temporary Residence Card (for foreigners); types of documents with photos issued by Vietnamese state management agencies.
When guests do not have identity documents, after being assigned to the room, they must immediately notify the local Commune, Ward, Commune-level Town police station, or the police station managing the area.
=> When staying at accommodation establishments, customers must present their identity documents for the accommodation establishment to check as stipulated.
In addition, Clause 4, Article 25 of Decree No. 96/2016/ND-CP also stipulates general responsibilities applicable to industries and professions as follows:
- Do not use business establishments to conduct activities contrary to the provisions of the law, affecting security, order, ethics, and traditional customs of the nation.
- ....
Thus, when renting a room, guests must take responsibility for their own behavior. At the same time, if the hotel owner knows that the guest is violating the law but still rents out the room for profit, they may be held criminally responsible for corresponding acts such as harboring prostitution, pimping, hiding, or concealing crimes.
=> Currently, the law does not prohibit men and women (who do not have a familial relationship) from renting a room to stay together; nor is there a regulation that men and women must be husband and wife (must have a marriage certificate) to rent a room together.However, if men and women want to rent a room together (when they do not have a familial relationship), hotels generally require them to be of legal age with full civil capacity, with a voluntary relationship not for purposes of prostitution or other profit, and actions that do not violate ethics and the law.
