Investment Capital Recovery and Profit Plan for Investors in PPP Projects

Section 6, Article 4, Decree 28/2021/ND-CP provides provisions on the plan for the recovery of investment capital and profit for investors as follows:

- The projected levels of prices and public service fees; specifically identifying the starting prices, fees, and the principles for adjusting prices and fees in accordance with the provisions of the Laws on Prices, Fees, and related legislation;

- The anticipated revenue from each lawful source of income for the PPP project enterprise;

- The timeline for implementation, operation, recovery of capital, and profit for the investor;

- For PPP projects implemented under BTL contracts or BLT contracts, the plan for the recovery of investment capital and profit for investors shall additionally provide regulations on the sources of payment funds for the PPP project enterprise including:

+ The schedule for the payment of public investment capital for the PPP project;

+ The schedule for the payment of regular expenses to the PPP project enterprise during the operational phase;

+ Revenue from the provision of public services by the PPP project enterprise (if any).
