Information Prohibited from Disclosure during the Selection Process for Investment under the PPP Method
According to Clause 5, Article 10 of the Law on Public-Private Partnership Investment 2020 (effective from January 01, 2021), the disclosure and receipt of the following documents and information regarding the investor selection process are strictly prohibited:
- The contents of the prequalification invitation dossier, the bidding dossier before the issuance as prescribed, except in cases where the project must conduct market surveys, consult with investors in advance to prepare the prequalification invitation dossier, and the bidding dossier;
- The contents of prequalification dossiers, bidding dossiers, reports of the bidding inviter, reports of expert teams, appraisal reports, consulting contractor reports, and the reports of relevant specialized agencies in the investor selection process, prequalification results, and investor selection results before being publicized as prescribed;
- Other documents in the investor selection process determined to contain state secrets according to the provisions of the law.
The above are the information that is strictly prohibited from disclosure during the investor selection process under the PPP method according to the provisions of the Law on Public-Private Partnership Investment 2020 (effective from January 01, 2021).
