How many years is a construction practicing certificate valid in Vietnam?
How many years is a construction practicing certificate valid in Vietnam? I currently want to be granted a construction practicing certificate, I would like to know how many years the above certificate is valid for? Which agency has power to issue construction practicing certificates in Vietnam?
1. How many years is a construction practicing certificate valid in Vietnam?
Pursuant to Clause 5, Article 62 of Decree 15/2021/ND-CP stipulating the term of construction practicing certificates is as follows:
5. The practicing certificate is valid for up to 05 years upon first issuance or adjustments to certificate rank or certificate renewal. Regarding the practicing certificate of a foreign individual, its effective period shall be determined according to the period specified in the work permit or temporary resident card issued by a competent authority but not exceed 05 years.
In case of issuance upon adjustments or supplementation to the certificate or re-issuance as the unexpired certificate is lost, damaged or misstated, the validity period of the new certificate shall coincide with the former certificate.
Thus, according to the above regulations in Vietnam, the practicing certificate is valid for up to 05 years upon first issuance or adjustments to certificate rank or certificate renewal. Regarding the practicing certificate of a foreign individual, its effective period shall be determined according to the period specified in the work permit or temporary resident card issued by a competent authority but not exceed 05 years.
2. Which agency has power to issue construction practicing certificates in Vietnam?
Pursuant to Clause 1, Article 64 of Decree 15/2021/ND-CP stipulating power to issue the practicing certificate as follows:
1. Power to issue the practicing certificate:
a) Construction authorities affiliated to the Ministry of Construction shall issue Rank-I practicing certificates;
b) Departments of Construction shall issue Rank-II and Rank-III practicing certificates;
c) Socio-professional organizations specified in Article 81 of this Decree shall issue Rank-II and Rank-III practicing certificates to their members.
Thus, according to the above regulations in Vietnam, construction authorities affiliated to the Ministry of Construction shall issue Rank-I practicing certificates, the Departments of Construction shall issue Rank-II and Rank-III practicing certificates, or socio-professional organizations shall issue Rank-II and Rank-III practicing certificates to their members.
