Dossier and Procedures for Submission, Appraisal, and Approval of PPP Projects

Article 37 of Decree 29/2021/ND-CP stipulates the dossier, procedures for submission, and appraisal for the approval of PPP projects as follows:

- The dossier of the competent authority submitted for appraisal as stipulated in Clause 1, Article 20 of the Law on Investment according to the public-private partnership method.

- The competent authority sends 01 set of dossiers as stipulated in Clause 1 of this Article to report to the Prime Minister the Government of Vietnam and simultaneously sends 20 sets of dossiers to the Ministry of Planning and Investment.

- Within 15 days from the date of receiving the project dossier, the Ministry of Planning and Investment shall report to the Prime Minister the Government of Vietnam to establish the State Appraisal Council as stipulated in Article 4 of this Decree.

- The State Appraisal Council appraises the project within 90 days from the date of establishment. In case of hiring consultancy for verification, the appraisal time of the State Appraisal Council is calculated from the date of signing the consultancy verification contract.

- The dossier of the State Appraisal Council is submitted to the Prime Minister the Government of Vietnam for review and decision on project investment as stipulated in Article 22 of the Law on Investment according to the public-private partnership method.

- The Prime Minister the Government of Vietnam reviews and decides on the project investment according to the working regulations of the Government of Vietnam.
