Competitive Bidding by Abbreviated Procedures: Are Organizing Entities Allowed to Select Contractors?
Based on Point b Clause 3 Article 38 of the Law on Tendering 2013 stipulates as follows:
The process for selecting a contractor for competitive quotations is carried out as follows:
For competitive quotations according to the standard procedure, the steps include: preparation for contractor selection; organization of contractor selection; evaluation of proposal dossiers and contract negotiations; submission, appraisal, approval, and public announcement of contractor selection results; completion and signing of contracts;
For competitive quotations under the streamlined procedure, the steps include: preparation and sending of quotation requests to contractors; contractors submit quotations; evaluation of quotations and contract negotiations; submission, approval, and public announcement of contractor selection results; completion and signing of contracts.
Thus, according to the above regulations, the process for selecting a contractor for competitive quotations under the streamlined procedure does not involve the organization of contractor selection, whereas the standard competitive quotation process does include this step.
