According to Article 23 of Circular 23/2021/TT-BGTVT, bid evaluation rules for investment in airport service works are as follows:
1. Bid evaluation must rely on bid evaluation criteria and other requirements under bidding documents, submitted bids, documents explaining and clarifying bids of investors in order to select investors with sufficient capacity and experience and sound technical, financial - commercial solutions to execute the projects.
2. Bid evaluation shall be carried out using photocopies, the consistency between which and the original copies must be guaranteed by investors. In case of any insignificant discrepancy between original copies and photocopies without altering ranking order of investors, the original copies shall prevail. In case of any significant discrepancy between original copies and photocopies which leads to difference between evaluation results based on original copies and those based on photocopies which alters ranking order of investors, bids of the investors will be eliminated.
3. Upon carrying out bid evaluation, procuring entities must inspect technical, financial - commercial aspects of bids in order to eliminate any deviation, reservation, and omission of any basic detail, in which:
a) Deviation refers to any deviation from requirements specified under bidding documents;
b) Reservation refers to the fact that investors lay out conditions that are restrictive or showing other than full compliance with requirements under bidding documents;
c) Omission of basic details refers to investors’ failure to provide any or all information and/or documents according to request under bidding documents.
4. As long as the bids qualify based on requirements under bidding documents, procuring entities can accept the errors that are other than deviations, reservations, or omission in bidding documents. In which, the deviations, reservations, and omission mean deviations, reservations, and omission whose acceptance or revision or replacement will lead to:
a) Significant impact on scope and technical, technological, quality requirements of works and infrastructures;
b) Significant limitation and inconsistency with bidding documents in powers of procuring entities, competent authorities, or obligations of investors under contracts;
c) Unfair impact on competitive position of other investors having bids qualifying based on requirements under the bidding documents;
5. Bids that do not qualify based on requirements under bidding documents will be eliminated; deviations, reservations, and omissions in bids are not allowed to be revised and rectified in order to make the bid qualify.
