Beyond Retirement Age, Can One Still Be the Chief Commander of a Construction Site?
Pursuant to Clauses 5 and 12, Article 1 of Decree 100/2018/ND-CP:
I. An individual may be granted a practicing certificate when meeting the following conditions:
- Possess full legal capacity as prescribed by law; have a residency permit or work permit in Vietnam for foreigners and overseas Vietnamese.
- Have professional qualifications and experience suitable for the content of the requested practicing certificate as follows:
+ Class I: Possess a university degree in a relevant field, with at least 07 years of experience in work related to the content of the requested practicing certificate;
+ Class II: Possess a university degree in a relevant field, with at least 04 years of experience in work related to the content of the requested practicing certificate;
+ Class III: Possess appropriate professional qualifications, with at least 02 years of experience in work related to the content of the requested practicing certificate for individuals with a university degree; at least 03 years for individuals with a college or intermediate level.
- Meet the requirements of the examination for the field in which the practicing certificate is requested.
II. An individual taking the position of site commander must meet the following conditions corresponding to the classification:
- Class I: Have a Class I construction supervision practicing certificate or have been a site commander for at least 01 project of Level I or 02 projects of Level II or higher of the same type.
- Class II: Have a Class II construction supervision practicing certificate or have been a site commander for at least 01 project of Level II or 02 projects of Level III or higher of the same type.
- Class III: Have a Class III construction supervision practicing certificate or have directly participated in construction of at least 01 project of Level III or 02 projects of Level IV or higher of the same type.
Therefore, the case you inquired about will have no age restriction for practicing, and if your qualifications are appropriate, you can work at companies in need.
