What are responsibilities of telecommunications enterprises in implementing the program of providing telecommunications services in Vietnam?

Pursuant to Article 49 of Circular 14/2022/TT-BTTTT (effective from December 12, 2022) stipulating responsibilities of telecommunications enterprises in implementing the program of providing telecommunications services in Vietnam as follows:

1. Participate in providing public-utility telecommunications services to the right subjects with quality, service prices and support levels as prescribed.

2. Propose plans, estimates, prices of public-utility telecommunications services and support levels for enterprises providing public-utility telecommunications services; coordinate in proposing support levels for users of public telecommunications services.

3. Implement and report fully, promptly and accurately information and data on the implementation of the Program and take responsibility before law for the reported data.

4. Enterprises that are selected to provide terrestrial mobile telecommunications services in difficult-to-access areas and are entitled to universalization of telecommunications services in the form of bidding are responsible for sharing telecommunications infrastructure in accordance with regulations of law.

What are responsibilities of users of public telecommunications services in Vietnam?

Pursuant to Article 50 of Circular 14/2022/TT-BTTTT (effective from December 12, 2022) stipulating responsibilities of users of public telecommunications services in Vietnam as follows:

Provide complete and accurate information necessary for the right subjects to be supported by relevant state agencies and for telecommunications service providers when requesting support to use public telecommunications services and take responsibility before law for the information and documents provided.

2. Households eligible for support to use universal telecommunications services shall only register to use universal telecommunications services with an enterprise providing public telecommunications services in their permanent residence.

3. Manage and use supported terminals for the right purposes; use public telecommunications services economically and efficiently.

How to transition the tasks of supporting the provision and use of public telecommunications services that have been performed since the beginning of 2022 in Vietnam?

Pursuant to Article 51 of Circular 14/2022/TT-BTTTT (effective from December 12, 2022) stipulating transition the tasks of supporting the provision and use of public telecommunications services that have been performed since the beginning of 2022 in Vietnam as follows:

1. The tasks to support the provision and use of public-utility telecommunications services from 2021, which will be carried out from January 1, 2022, shall be carried out according to the policies within the scope of the Program's support according to the guidance of the Ministry of Information and Communications until the end of December 2022. The Program's support after December 2022 for all tasks shall comply with the provisions of this Circular.

Telecommunications businesses are responsible for reviewing subscribers who are using postpaid terrestrial mobile telecommunications services to ensure conditions for support and documents as prescribed in this Circular.

2. The plan and cost estimate for the implementation of the Program from January 1, 2022 onward shall be aggregated, paid and settled into the funding source for the implementation of this Program.
