Pursuant to Article 6 Regulations on receiving, processing, issuing and managing electronic documents between Courts and units in the People's Court issued with Decision 296/QD-TANDTC in 2022 (Effective from November 1, 2022) regulates time of sending and receiving electronic documents as follows:

1. The time of sending an electronic document is the time that electronic document is released on the document management and administration system and there is a response to the successfully sent document.

2. The time of receipt of an electronic document is the time the electronic document is entered into the document management and operating system so that the receiving party can access and use the electronic document from that time or is confirmed by the receiving party or successfully recorded by the document management and administration system.

What is inspection and assurance of integrity of electronic documents between Courts and units in the People's Court in Vietnam?

According to Article 7 Regulations on receiving, processing, issuing and managing electronic documents between Courts and units in the People's Court issued with Decision 296/QD-TANDTC in 2022 (Effective from November 1, 2022) regulates inspection and assurance of integrity of electronic documents as follows:

1. The integrity of an electronic document is when the content of the electronic document is not changed during the process of exchange, processing and issuance.

2. Electronic documents are checked for integrity based on the following basic information:

a) Document format includes: National name and motto; name of agency or unit issuing the document; numbers and text symbols; place name and time of issuance of the document; type name and summary of the text's content; text content; position, full name and signature of the competent person; seal and signature of agency or unit; recipients;

b) Data file structure containing electronic documents.

2. Types of electronic documents sent with paper documents

a) Electronic documents attached to paper documents are specified in Point a, Clause 2, Article 7, Decision 28/2018/QD-TTg dated July 12, 2018 of the Prime Minister on sending and receiving electronic documents between agencies in the state administrative system.

b) Documents according to the list decided by the Chief Justice of the Supreme People's Court, in addition to the documents specified in Point a, Clause 2 of this Article.
