Cases of Permitting the Sale of Shares Immediately After Repurchasing Shares

I would like to know if a company repurchasing its own shares can sell them immediately afterward, and if so, in which case this applies? What is the provision according to the new law?

Based on Clause 7, Article 36 of the 2019 Securities Law (effective January 1, 2021), it is stipulated as follows:

- Securities companies and public companies repurchasing their own shares can resell the shares immediately after repurchase in the following cases:

+ Securities companies repurchase their own shares to correct trading errors or repurchase odd-lot shares;

+ Public companies repurchase odd-lot shares according to the plan to issue shares to pay dividends, the plan to issue shares from owner equity;

+ Public companies repurchase odd-lot shares at the request of shareholders.

The above are the cases where shares can be resold immediately after they are repurchased by securities companies.

Respectfully!
