Will the Law on People's Air Defense 2024 in Vietnam be effective from July 01, 2025?
The Law on People's Air Defense 2024 Download was passed by the National Assembly of the Socialist Republic of Vietnam, 15th Legislature, during its 8th session on November 27, 2024.
The Law on People's Air Defense 2024 Download regulates the principles, duties, forces, activities of People's air defense; management of unmanned aircraft, other flying means, and ensuring air defense safety; resources, policies, rights, obligations, responsibilities of agencies, organizations, enterprises, and individuals related to People's air defense.
Article 3 of the Law on People's Air Defense 2024 Download stipulates the principles for organizing People's air defense activities as follows:
- Under the leadership of the Communist Party of Vietnam, the unified state management of the Government of Vietnam and the direction and command of the Minister of National Defense, along with the direction and administration of local governments.
- In compliance with the Constitution, Vietnamese law, and international treaties to which the Socialist Republic of Vietnam is a party.
- Organized uniformly from the central to local levels; ensuring initiative, promptness, effectiveness, safety, with the allocation, delegate, and tight coordination between air defense forces and agencies, organizations, enterprises, individuals in People's air defense activities.
- Prepared regularly, continuously during peacetime and promptly implement necessary measures according to the decision of authorized levels to manage and protect the airspace of the Fatherland.
- Building a People's air defense force and continuous, extensive, and solid People's air defense posture; leveraging the combined strength of the entire political system and all people; closely integrating economic-social development with strengthening national defense, security, and building defense zones.

What are the State's policies regarding people's air defense in Vietnam?
Based on Article 4 of the Law on People's Air Defense 2024 Download, the state policies regarding People's air defense are as follows:
- Ensure state resources and mobilize resources from agencies, organizations, enterprises, individuals to fulfill the duties of People's air defense; prioritize budget supplementation for key People's air defense areas, and localities with special difficulties having strategically important positions on national defense and security to meet the requirements of managing and protecting the airspace of the Fatherland.
- Have policies to enhance the capacity of the People's air defense force; nurture human resources, prioritize attracting high-quality human resources for People's air defense activities; invest in physical infrastructure, equipment for the People's air defense force.
- Prioritize investment in science and technology in People's air defense activities and management of unmanned aircraft, other flying means.
- Encourage and facilitate agencies, organizations, enterprises, individuals to voluntarily support materials, finances, and spirit for People's air defense activities, ensuring compliance with Vietnamese law and international laws.
Which agencies has the authority to direct the people's air defense in Vietnam?
Based on Article 9 of the Law on People's Air Defense 2024 Download, the agencies directing People's air defense are defined as:
Article 9. Agencies directing People's air defense
- Agencies directing People's air defense include:
a) The Government of Vietnam directs People's air defense nationwide;
b) The Ministry of National Defense assists the Government of Vietnam in directing People's air defense;
c) The Military Region Command directs People's air defense in the military region;
d) People's Committees at different levels direct and organize the implementation of People's air defense in their localities.
- The People's air defense steering committee is organized at the central, military region, and local levels. The People's air defense steering committees at all levels have the task of advising, assisting the corresponding level's People's air defense directing agency.
- The Ministry of National Defense is the standing agency of the Central People's air defense Steering Committee; the Military Region Staff Department is the standing agency of the Military Region People's air defense Steering Committee; local military agencies at different levels are the standing agencies of their corresponding level's People's air defense Steering Committee.
- The Government of Vietnam prescribes in detail the position, function, duties, organizational structure, and activities of People's air defense steering committees at all levels.
Thus, the following agencies direct People's air defense:
- The Government of Vietnam directs People's air defense nationwide
- The Ministry of National Defense assists the Government of Vietnam in directing People's air defense
- The Military Region Command directs People's air defense in the military region
- People's Committees at different levels direct and organize the implementation of People's air defense in their localities
