Will Party members who commit sexual harassment be expelled from the Party in Vietnam?

Pursuant to Article 54 of Regulation 69-QD/TW of 2022, there are provisions as follows:

1. Party members who violate one of the following cases and cause less serious consequences will be disciplined in the form of reprimand:

a) Organizing weddings, funerals, holidays, birthdays, longevity celebrations, wedding anniversaries, new home celebrations, promotions, job transfers are lavish, wasteful or for profit-seeking purposes, causing harm to public opinion in society or contrary to the regulations of the agency, unit, or locality of residence.

b) Violating regulations prohibiting the consumption of alcohol, beer and other stimulants.

c) Committing sexual harassment in any form.

d) Committing acts that disrupt security and public order (disturbing, quarreling, fighting...).

d) Untruthfully reporting the results of one's moral cultivation, training, and lifestyle when requested by a competent party organization.

e) Letting your spouse and children live lavishly and wastefully, causing bad public opinion in society or violating the law.

2. In case you have been disciplined according to Clause 1 of this Article but commit a repeat violation or the first violation causes serious consequences or violate one of the following cases, the disciplinary action will be in the form of a warning or dismissal (if you have a position):

a) Being irresponsible or for personal reasons, condoning or inciting others to violate the law.

b) Committing acts of harming the health, honor or dignity of others; fraud, misappropriation of assets and money of organizations and individuals.

c) Failing to implement inspection and supervision plans for cadres and party members who violate the cultivation and training of ethics and lifestyle.

d) Committing acts that violate regulations on professional ethical standards of the industry, agency or unit.

d) Violating traffic safety regulations causes accidents and damages the health and property of others.

3. In case of violation of Clauses 1 and 2 of this Article causing very serious consequences or violating one of the following cases, discipline will be in the form of expulsion:

a) Being a leader or commander but committing acts that seriously offend dignity and honor or using corporal punishment on officers, soldiers, and employees under their authority.

b) Being a subordinate but committing acts that seriously offend dignity, honor or assaulting leaders, managers, commanders and colleagues.

According to this Article, Party members who commit sexual harassment in any form may be disciplined in the form of a reprimand. If they cause very serious consequences, they may be expelled from the Party in Vietnam.

What are penalties for sexual harassment in Vietnam? 

According to Clause 5, Article 7, Decree 144/2021/ND-CP stipulates a fine ranging from 5.000.000 VND to 8.000.000 VND shall be imposed for any of the following violations:

a) Deliberately inflicting injuries or bodily harm to another person but not liable to criminal prosecution;

b) Disrupting public order while carrying cold weapons, combat gears or other items that can cause injuries;

c) Filming, photographing, charting an restricted area that is relevant to defense and security;

d) Molestation of a person under 16 but not liable to criminal prosecution;

dd) Molestation, sexual harassment;

e) Engaging in sexual acts in public;

g) Perform designing, manufacturing, repairing, maintaining, testing UAVs or ultralight aircrafts, engines, propellers and parts thereof against the categories or quality specified in the license issued by a competent authority;

h) Using UAVs and ultralight aircrafts to launch, drop harmful or dangerous objects or substances without permission.

According to this Article, people who commit sexual harassment can be fined from 5,000,000 VND to 8,000,000 VND and forced to publicly apologize to the victim in Vietnam.
