Will officers of the Vietnam Border Guard be given priority in land allocation? What are rights of the Vietnam Border Guard officers?

Hello Lawnet. I am planning to take the exam for the Vietnam Border Guard Academy. I would like to know if after graduating from the academy, Border Guard officers will be given priority in land allocation. Is that correct?

Will officers of the Vietnam Border Guard be given priority in land allocation?

Based on Article 4 of Decree 106/2021/ND-CP, the following preferential policies and special regimes are applicable to officers and soldiers of the Vietnam Border Guard:

1. Officers, professional soldiers, workers, and civil servants of the Border Guard who have been assigned to border protection tasks for a period of at least 5 years and have a need to move their families to permanently settle in border areas will be prioritized for land allocation by local authorities in accordance with land laws. They will also be provided with housing assistance for their families, employment assistance for their spouses, and other benefits as prescribed.

2. Officers and soldiers of the Border Guard, in addition to enjoying the salary, allowances, and other policies of the Vietnam People's Army, will also be entitled to a responsibility allowance for border protection and maritime defense during the time they are directly involved in border management and protection duties.

3. Officers, professional soldiers, workers, and civil servants of the Border Guard who have been continuously working in border areas, islands, or archipelagoes for at least 5 years will be entitled to a monthly allowance for long-term service in border areas and maritime defense. In cases where the allowance for long-term service in border areas and maritime defense is regulated by multiple documents, only the highest level of the policy will be applied.

4. Officers and professional soldiers of the Border Guard who are assigned to work as reinforcement cadres in border communes with particularly difficult economic and social conditions will be entitled to a monthly allowance for concurrent duties and an additional annual health care allowance as prescribed by law.

Therefore, officers of the Vietnam Border Guard will be given priority in land allocation if they have been assigned to border protection tasks for a period of at least 5 years and have a need to move their families to permanently settle in border areas.

What are rights of the Vietnam Border Guard officers?

Based on Article 15 of the Law on Vietnam Border Guard in 2020, the Vietnam Border Guard officers have the following rights:

1. To deploy, use forces, equipment, and technical equipment to carry out their duties; to apply forms and measures for managing and protecting the national border as prescribed in Articles 19 and 20 of this Law.

2. To patrol, inspect, control, manage, and protect the national border, the system of national border markers, marking objects, border signs, border works, and border gates; to issue, amend, supplement, and revoke visas and other documents in the field of managing and protecting the national border; to inspect and control vehicles with signs of violating the law, and to handle vehicles that violate the law in border areas and border gates in accordance with the law.

3. To combat, prevent, investigate, and handle violations of the law in border areas and border gates in accordance with the law.

4. To restrict or temporarily suspend activities in the border belt, border areas, and cross-border activities at border gates and open crossings in accordance with Article 11 of this Law.

5. To use weapons, explosives, and riot control equipment in accordance with Article 17 of this Law.

6. To mobilize civilians, ships, vehicles, and technical equipment in accordance with Article 18 of this Law.

7. To directly pursue and arrest persons and vehicles that violate the law from the border into the interior; to cooperate with other forces to search for and arrest persons who have committed acts of violating the law and fled into the interior; to pursue and arrest persons and vehicles that violate the law and flee from within the internal waters and territorial waters of Vietnam outside the scope of Vietnam's territorial waters in accordance with the laws of Vietnam and international treaties to which the Socialist Republic of Vietnam is a member.

8. To cooperate and coordinate with the functional forces of countries with common borders, other countries, and international organizations in managing, protecting the national border, border gates, combating crime, and violations of the law in accordance with the laws of Vietnam and international treaties to which the Socialist Republic of Vietnam is a member.
