Will gifts to families and individuals who have contributed to the revolution be increased in the near future in Vietnam?

In Clause 13, Article 1 of the Draft Decree amending Decree 75/2021/ND-CP, there is a proposal for a gift-giving regime for families and individuals of people with meritorious services to the revolution as follows:

Amending and supplementing a number of articles of Decree No. 75/2021/ND-CP dated July 24, 2021 of the Government regulating the levels of benefits, allowances and preferential regimes for people with meritorious services to the revolution

13. Amend Clause 11, Article 13 as follows:

“a) Gifts from Leaders of the Party, State, National Assembly, and Chairman of the Central Committee of the Vietnam Fatherland Front:

Gift level for groups: Cash is 5,000,000 VND/group, in-kind items are worth 500,000 VND/group.

Gift level for families and individuals: Cash is 1,000,000 VND/family or individual; artifacts worth 250,000 VND/family or individual.

b) Gifts from leaders of ministries and central agencies:

Gift level for groups: Cash is 3,000,000 VND/group; Artifacts worth 500,000 VND/group.

Gift level for families and individuals: Cash is 1,000,000 VND/family or individual; artifacts worth 250,000 VND/family or individual.”

In Clause 11, Article 13 of Decree 75/2021/ND-CP, there are regulations on the gifting regime for families of people with meritorious service as follows:

Other preferential regimes

...

11. Gifting regime for establishments nurturing people with meritorious services, people with meritorious services and families of people with meritorious services:

a) Gifts from Leaders of the Party, State, National Assembly, and Chairman of the Central Committee of the Vietnam Fatherland Front:

Gift level for groups: Cash is 5,000,000 VND/group; Artifacts worth 500,000 VND/group.

Gift level for families and individuals: Cash is 500,000 VND/family or individual; artifacts worth 150,000 VND/family or individual.

b) Gifts from leaders of ministries and central agencies:

Gift level for groups: Cash is 3,000,000 VND/group; Artifacts worth 500,000 VND/group.

Gift level for families and individuals: Cash is 500,000 VND/family or individual; artifacts worth 150,000 VND/family or individual.

Thus, the new draft proposes to adjust the gift levels for families and individuals who have contributed to the revolution as follows:

- Gifts from leaders of the Party, State, National Assembly, and Chairman of the Central Committee of the Vietnam Fatherland Front to families and individuals who have contributed to the revolution are 1,000,000 VND in cash/family or individual; artifacts worth 250,000 VND/family or individual.

- Gifts from leaders of ministries and central agencies with a cash amount of 1,000,000 VND/family or individual; artifacts worth 250,000 VND/family or individual.

 

Will there be an increase in preferential allowance standards for people with meritorious services to the revolution in Vietnam?

In Clause 1, Article 1 of the Draft Decree amending Decree 75/2021/ND-CP on the standard level of preferential benefits for people with meritorious services to the revolution is proposed as follows:

Amending and supplementing a number of articles of Decree No. 75/2021/ND-CP dated July 24, 2021 of the Government regulating the levels of benefits, allowances and preferential regimes for people with meritorious services to the revolution

1. Amend Clause 1, Article 3 as follows:

Option 1:

"1. The standard level of preferential allowance for people with meritorious services to the revolution is 2,055,000 VND (hereinafter referred to as the standard level)".

Plan 2:

"1. The standard level of preferential allowance for people with meritorious services to the revolution is 2,111,000 VND (hereinafter referred to as the standard level).”

In Clause 1, Article 3 of Decree 75/2021/ND-CP, there are regulations on the standard level of preferential subsidies as follows:

Standard preferential subsidy level

1. The standard level of preferential allowance for people with meritorious services to the revolution is 1,624,000 VND (hereinafter referred to as the standard level).

Thus, according to the draft Decree, two options are proposed to increase the standard level of preferential benefits for people with meritorious services to the revolution in Vietnam as follows:

- Option 1: The standard preferential allowance for people with meritorious services to the revolution is 2,055,000 VND compared to the previous rate of 1,624,000 VND (ie an increase of 431,000 VND)

- Option 2: The standard level of preferential allowance for people with meritorious services to the revolution is 2,111,000 VND (ie increased (an additional 487,000 VND).

What is expected maximum spending on gifts for people with meritorious services to the revolution to restore their health in Vietnam?

In Clause 4, Article 1 of the Draft Decree amending Decree 75/2021/ND-CP, there are regulations on health recovery nursing as follows:

Amending and supplementing a number of articles of Decree No. 75/2021/ND-CP dated July 24, 2021 of the Government regulating the levels of benefits, allowances and preferential regimes for people with meritorious services to the revolution

4. Amend and supplement point c, clause 2, Article 6 as follows:

“c) Gifts to beneficiaries (maximum spending level 20% of centralized health rehabilitation nursing spending)”.

At Point c, Clause 2, Article 6 of Decree 75/2021/ND-CP, there are regulations on health recovery nursing as follows:

Health recovery nursing

1. Nursing rehabilitation at home: The cost is 0.9 times the standard rate/1 person/1 time and is paid directly to the beneficiaries.

2. Concentrated health recovery nursing: Expenditure is 1.8 times the standard rate/person/time. Contents include:

a) Food expenses during the nursing period;

b) Essential drugs;

c) Gifts;

d) Other expenses that directly serve the patient during the nursing period (maximum expenditure is 15% of the concentrated health recovery nursing expenditure), including: towels, soap, brushes, toothpaste teeth, sightseeing, photography, health consultation, rehabilitation, books, newspapers, cultural activities, arts, sports and other expenses serving nursing subjects.

Thus, it is expected that gifts for people with meritorious services to the revolution will have a maximum spending level of 20% of the spending on centralized health rehabilitation nursing.

Note: The draft Decree amending Decree 75/2021/ND-CP is being consulted and has not yet taken effect.
