Violation of provisions on the prevention of domestic violence:

1. If a party member commits one of the following cases resulting in less serious consequences, disciplinary action will be taken in the form of reprimand:

a) Using or disseminating information, images, sound, or objects that incite or provoke domestic violence.

b) Obstructing the exercise of rights and obligations in family relationships between grandparents and grandchildren, parents and children, spouses, or siblings.

c) Showing indifference, apathy, or obstructing the detection, reporting, and handling of domestic violence.

2. If a party member has been disciplined according to the provisions in Clause 1 of this Article and they reoffend or commit a first violation resulting in serious consequences or commit one of the following cases, disciplinary action will be taken in the form of a warning or removal from their position (if holding a position):

a) Misappropriating or damaging the personal property of a family member or the shared property of the family.

b) Forcing family members to work excessively or coercing them to contribute financially beyond their capacity; controlling the income of family members to create financial dependency.

c) Forcing a family member to leave their residence illegally.

d) Using force, incitement, instigation, or aiding others in committing domestic violence.

e) Condoning, covering up, failing to handle, or mishandling domestic violence incidents according to the law.

3. If a party member violates the provisions in Clause 1 or Clause 2 of this Article resulting in very serious consequences or commits one of the following cases, disciplinary action will be taken in the form of expulsion:

a) Seeking revenge, suppressing or retaliating against those who discover, report, or prevent domestic violence.

b) Physically abusing, mistreating, beating, or engaging in other acts that harm the health or life; defaming, insulting, or damaging the dignity and integrity of family members; isolating, expelling, or exerting constant psychological pressure on family members or those who have raised them.

These provisions aim to address and prevent domestic violence within the Party, ensuring that the rights, safety, and well-being of individuals within the family unit are protected and respected.

Therefore, a Communist Party of Vietnam member who engages in domestic violence will be subject to disciplinary action within the Party, specifically through expulsion from the Party.

What behaviors are strictly prohibited in the prevention of domestic violence in Vietnam?

In accordance with Article 5 of the Law on the Prevention and Control of Domestic Violence 2022, the prohibited behaviors in the prevention of domestic violence are as follows:

- Acts of domestic violence as stipulated in Article 3 of the Law on the Prevention and Control of Domestic Violence 2022.

- Inciting, instigating, enticing, persuading, aiding, or coercing others to engage in acts of domestic violence.

- Using or disseminating information, materials, images, or sounds to incite domestic violence.

- Seeking revenge or threatening revenge against those who have assisted victims of domestic violence, those who have discovered or reported incidents, or those who have intervened to prevent domestic violence.

- Obstructing the detection, reporting, disclosure, prevention, and handling of domestic violence.

- Exploiting activities in the prevention and control of domestic violence to engage in illegal acts.

- Condoning, covering up, failing to handle, or mishandling domestic violence incidents in violation of legal regulations.

Which agency receives reports and disclosures regarding acts of domestic violence in Vietnam?

According to Article 19 of the Law on the Prevention and Control of Domestic Violence 2022, the provisions regarding reporting and disclosure of acts of domestic violence are as follows:

Reporting and Disclosure of Acts of Domestic Violence

1. The addresses that receive reports and disclosures regarding acts of domestic violence include:

a) The commune-level People's Committee where the act of domestic violence occurred;

b) The local Police Department, Border Guard Station near the location of the act of domestic violence;

c) The educational institution where the victim of domestic violence is a student;

d) The village chief, neighborhood leaders, or the head of the Front Office in the residential area where the act of domestic violence occurred;

e) The head of the socio-political organization at the commune level where the act of domestic violence occurred;

f) The national hotline for the prevention and control of domestic violence.

2. Reporting and disclosing acts of domestic violence to the addresses specified in paragraph 1 of this Article can be done through the following forms:

a) Phone calls, text messages;

b) Submitting written requests or letters;

c) Reporting directly in person.

3. The government regulates the national hotline for the prevention and control of domestic violence to receive and handle reports and disclosures of acts of domestic violence.

According to these regulations, the addresses that receive reports and disclosures regarding acts of domestic violence include:

- The commune-level People's Committee where the act of domestic violence occurred;

- The local Police Department, Border Guard Station near the location of the act of domestic violence;

- The educational institution where the victim of domestic violence is a student;
