Who elects the President of Vietnam?

Pursuant to Article 87 of the Constitution of the Socialist Republic of Vietnam in 2013 stipulating following regulations:

The President shall be elected by the National Assembly from among its deputies.

The President is responsible, and shall report on his or her work, to the National Assembly.

His or her term of office follows the term of the National Assembly. At the expiration of the term of the National Assembly, the President shall remain in office until a new President is elected by the succeeding National Assembly.

As regulations above, the President is the Head of State of Vietnam and shall represent the Socialist Republic of Vietnam internally and externally.

The President shall be elected by the National Assembly from among its deputies.

What is the term of office of the President of Vietnam?

Pursuant to Article 87 of the Constitution of the Socialist Republic of Vietnam in 2013 stipulating following regulations:

The President shall be elected by the National Assembly from among its deputies.

Pursuant to Article 2 of the Law on Organization of the National Assembly in 2014 stipulating term of the National Assembly:

Term of the National Assembly

1. The term of the National Assembly is five years, counting from the opening date of the first session of the National Assembly of a term to the opening date of the first session of the National Assembly of the succeeding term.

2. Sixty days before the expiration of the term of the National Assembly, a new National Assembly shall be elected.

3. In special cases, the National Assembly shall decide to shorten or extend its term at the proposal of the Standing Committee of the National Assembly, if at least two-thirds of the total number of National Assembly deputies vote for it. The extension of a term of the National Assembly must not exceed twelve months, except in wartime.

As regulations above, the President's term of office follows the term of the National Assembly, except for special cases. Therefore, the term of office of the President of Vietnam is 05 years.

What are the criteria for the President of Vietnam?

The criteria for the President of Vietnam include:

(1) General criteria:

Based on Subsection 1, Section 1 of the Regulation 214-QD/TW in 2020, the general criteria for the position of the President of Vietnam are as follows:

- Political and ideological criteria:

Absolute loyalty to the interests of the Communist Party of Vietnam, the nation, and the people; steadfast adherence to Marxism-Leninism, Ho Chi Minh's ideology, the goals of national independence and socialism, and the Communist Party of Vietnam's renewal path.

Possessing strong political stance, viewpoints, and political acumen; resolutely safeguarding the ideological foundation, Communist Party of Vietnam's principles, and directions, as well as the Constitution and laws of the State.

Having a deep and profound love for the country; always prioritizing the interests of the Communist Party of Vietnam, the nation, and the people over the interests of sectors, localities, agencies, and individuals; ready to sacrifice for the revolutionary cause of the Communist Party of Vietnam and for the independence and freedom of the Fatherland.

Maintaining strict discipline in public speaking according to the principles and regulations of the Communist Party of Vietnam.

- Ethical and lifestyle criteria:

Exemplary in ethical qualities; living with honesty, humility, sincerity, integrity, simplicity, tolerance; being diligent, frugal, upright, dedicated, and selfless.

Not being ambitious for power, but having enthusiasm and high responsibility for work; being the center of unity and a role model in all aspects.

Not engaging in corruption, waste, opportunism, and personal gain; resolutely fighting against and preventing the decline in political ideology, ethics, lifestyle, the occurrence of "self-evolution," "self-transformation" within the internal system, negative phenomena such as nepotism, corruption, waste, abuse of power and group interests; absolutely not exploiting and not allowing relatives or acquaintances to exploit their position and power for personal gain.

Strictly implementing the principles and discipline of the Communist Party of Vietnam's organization, fully and correctly performing their own powers and responsibilities, and directing the strict implementation of principles, regulations, procedures regarding personnel work.

- Educational qualifications:

Having a university degree or higher; a bachelor's or higher degree in political theory; a senior or equivalent specialist in state management; appropriate foreign language and computer skills.

- Capacity and credibility:

Having an objective, comprehensive, dialectical, specific historical viewpoint, innovative thinking, strategic vision; scientific working methods; being politically astute.

Having the ability to concretize and effectively lead, direct, and organize the implementation of the Communist Party of Vietnam's guidelines, policies, and laws of the State; having the ability to summarize practical experiences, conduct theoretical research, analysis, and good forecasting.

- Health, age, and experience:

Having sufficient health to perform duties; ensuring the age for appointment and nomination as regulated by the Communist Party of Vietnam. Having experienced and successfully fulfilled responsibilities and tasks in key leadership and management positions at the lower level; having significant practical experience.

(2) Specific criteria:

Based on Subsection 2.4, Section 2 of the Regulation 214-QD/TW 2020, the specific criteria for the President of Vietnam are as follows:

Fulfilling all the general criteria of a member of the Politburo, the Secretariat, while also possessing qualities and capabilities: Having high credibility, being the center of unity within the Central Party Committee, the Politburo, the entire Communist Party of Vietnam, and the people.

Having outstanding and comprehensive capabilities in all aspects of work, especially in the areas of domestic and foreign affairs, security, and defense; having deep and extensive knowledge of judicial work.

Being the center of unity for social forces and ethnic communities within and outside the country.

Being resolute in leadership and management according to assigned functions, tasks, and powers.

Having experienced and successfully fulfilled duties in the position of Provincial Party Secretary, City Party Secretary, or head of a central-level committee, ministry, or sector; having served in the Politburo for at least one term; special cases decided by the Central Executive Committee.

Thus, the criteria for electing the President of Vietnam are based on and evaluated through multiple aspects such as criteria related to ideology, ethics, capacity, education, health, credibility, and experience. Additionally, the election of the President also depends on the understanding and determination in leading state affairs.
