Who Does a Person Infected with HIV Notify to Be Exempt from Military Service?
In Clause 3, Article 4 of Circular 148/2018/TT-BQP, the health standards for participants in military service are stipulated as follows:
Health Standards:
- Select citizens with health categories 1, 2, and 3 according to the provisions of Interministerial Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016, of the Minister of Health - Minister of National Defense stipulating the medical examination for military service requirements.
- For agencies, units, positions specified in Point b, Clause 2 of this Article, selection is to be carried out ensuring separate standards as prescribed by the Ministry of National Defense.
- Do not enlist in the Army those citizens with health category 3 eye refractive errors (nearsightedness of 1.5 diopters or more, any degree of farsightedness); drug addiction, HIV, AIDS.
=> Thus, participants must meet the health standards as stipulated above. In cases where a person is infected with HIV, they fall under the category of not being enlisted in the Army.
Therefore, someone who does not know they are infected will be determined through the selection examination process. If they have already tested positive for HIV, they can provide their results (test certificate) to the Military Service Examination Council for consideration and guidance. Sincerely.
