Who Works Under Contract 68?

According to the provisions in Article 1 of Decree 68/2000/ND-CP as amended by Clause 1, Article 3 of Decree 161/2018/ND-CP:

The following types of work contracts are implemented in state administrative agencies and public service providers:

  1. Repair and maintenance for electricity supply systems, water supply and drainage systems in offices, automobiles, and other machinery and equipment being used in agencies and public service providers;
  2. Driving;
  3. Security services;
  4. Cleaning services;
  5. Parking services for officials and visitors working with agencies and public service providers;
  6. Other auxiliary work and services requiring educational qualifications from intermediate level or lower.

Additionally, cases that are not allowed to implement Contract 68 policies are specified in Article 3 of Decree 68/2000/ND-CP as amended by Clause 3, Article 3 of Decree 161/2018/ND-CP:

- People doing specialized tasks in positions determined as officials in state administrative agencies or as public employees in public service providers funded wholly or partially by the state for regular expenses.- Security personnel in offices such as the Government Office of Vietnam, cash reserves or record storage with value equivalent to money of the State Bank of Vietnam, State Treasury, tax stamp storage, and customs stamp storage.- Drivers of specialized vehicles transporting money of the State Bank of Vietnam, State Treasury.

Salary Arrangement for Those Under Contract 68 According to New Regulations

Based on the provisions in Clause 2 Article 4 of Circular 03/2019/TT-BNV, the salary arrangement for individuals working under Contract 68 is as follows:

Individuals signing labor contracts for performing the tasks specified in Article 1 of Decree 68/2000/ND-CP, as stipulated in Clause 1, Article 3 of Decree 161/2018/ND-CP, and applying the salary table specified in Decree No. 204/2004/ND-CP dated December 14, 2004, by the Government of Vietnam regarding salary policies for officials, public employees, and armed forces, will transition to signing labor contracts under the provisions of Article 3 of Decree No. 161/2018/ND-CP; the salary in the new labor contract shall not be lower than the current salary.

Thus, according to this regulation, those who signed contracts under Decree 68 will cease to apply the salary policies according to the salary table for officials and public employees and will receive salaries according to the labor contract, ensuring that the new salary is not lower than the current salary.
