Based on Clause 2, Article 23 of the 2023 Identification Law, the regulations are as follows:

  1. Individuals under 14 years of age or their legal representatives can request the identification management agency to issue an ID card. The procedures for issuing ID cards to individuals under 14 years of age are implemented as follows:

a) The legal representative conducts the procedures for issuing ID cards for individuals under 06 years of age through the public service portal or the national identification application. In case the individual under 06 years of age has not yet registered their birth, the legal representative carries out the process for issuing ID cards through interconnected procedures with birth registration on the public service portal, national identification application, or directly at the identification management agency. The identification management agency does not collect identification information and biometric information for individuals under 06 years of age;

According to Article 19 of the 2023 Identification Law, individuals eligible for ID cards include:

Individuals eligible for ID cards

  1. Those who are eligible for ID cards are Vietnamese citizens.

  2. Vietnamese citizens who are 14 years old or older are required to complete the procedures for obtaining an ID card.

3. Vietnamese citizens under 14 years of age may obtain an ID card based on demand.

Those eligible for an ID card include:

- Vietnamese citizens.

- Vietnamese citizens who are 14 years old or older are required to complete the procedures for obtaining an ID card.

- Vietnamese citizens under 14 years of age may obtain an ID card based on demand.

Thus, according to the above regulations, children under 6 years old are not required to get an ID card from July 1, 2024, but only upon request.

What prohibited acts are related to ID cards?

Based on Article 7 of the 2023 Identification Law, the following acts related to ID cards are prohibited:

[1] Issuing, reissuing, renewing, or revoking ID cards or ID certificates in contravention of legal regulations.

[2] Illegally retaining ID cards or ID certificates.

[3] Harassing, causing difficulties, or engaging in discriminatory practices when handling administrative procedures related to identification, the National Population Database, and the Identification Database.

[4] Falsifying records, documents related to identification, information in the National Population Database, and the Identification Database; not providing, providing insufficient, inaccurate, or unlawful information and documents about identification or information in the National Population Database, and the Identification Database.

[5] Failing to perform the procedures for issuing ID cards when Vietnamese citizens are 14 years of age or older.

[6] Producing, deploying tools, devices, software, or performing other acts causing obstruction or disruption to the operations of the information infrastructure of the National Population Database, the Identification Database, the electronic identification and authentication system.

[7] Counterfeiting, altering, intentionally distorting the content of ID cards, electronic IDs, or ID certificates; unlawfully appropriating or using another person’s ID cards, electronic IDs, or ID certificates; renting, leasing, pawning, accepting pawn, destroying ID cards, or ID certificates; using counterfeit ID cards, counterfeit electronic IDs, or counterfeit ID certificates.

[8] Unauthorized access, alteration, deletion, dissemination, or performing other acts related to the processing of personal data in the National Population Database, the Identification Database, the electronic identification and authentication system.

[9] Illegally exploiting, sharing, buying, selling, exchanging, appropriating, or using the information, data in the National Population Database, the Identification Database, the electronic identification and authentication system.
