Which business lines are required to have the Certificate of satisfaction of security and order conditions in Vietnam?

Pursuant to Article 14 of the Decree 96/2016/ND-CP (amended by Clause 2 Article 1 of the Decree 56/2023/ND-CP) stipulating certificate of satisfaction of security and order conditions:

Certificate of satisfaction of security and order conditions

The certificate of satisfaction of security and order conditions (Form No. 01 in the Annex to this Decree) is a document issued by a competent police authority to business establishments investing in the business lines mentioned in Article 3 of this Decree. The certificate of satisfaction of security and order conditions issued to a business establishment in the form of a physical or electronic document being equally authentic, if the business establishment so requests, issue physical document and electronic document at the same time as the public service portal and the information system for handling administrative procedures of the Ministry of Public Security are completed and put into operation.

As regulated above, the business lines required to have the Certificate of satisfaction of security and order conditions in Vietnam are stipulated in Article 3 of the Decree 96/2016/ND-CP, including:

- Seal production

- Combat gear trading

- Firecracker trading

- Pawnshop services

- Massage services

- Trading of warning devices of emergency vehicles

- Security services

- Trading of paintball guns

- Electronic casino game services for foreigners.

- Debt collection services

- Casino business

- Betting services

- Gas business

- Industrial explosive business

- Explosive precursor business

- Business operations with use of industrial explosives and explosive precursors

- Blasting services

- Printing services

- Trading in mobile phone jammers

- Plastic surgery services

- Karaoke and dance club business

- Accommodation services

- Trading in military clothing and equipment of the armed forces, military weapons, technologies, devices, and vehicles for the military forces and police forces; parts, components, supplies, specialized equipment, and technologies for manufacturing thereof.

When shall the validity of a Certificate of satisfaction of security and order conditions in Vietnam be defined?

Pursuant to Article 15 of the Decree 96/2016/ND-CP stipulating validity of certificate of sastisfaction of security and order conditions:

Validity of certificate of sastisfaction of security and order conditions

1. A certificate of sastisfaction of security and order conditions shall not have expiry date, except for the cases mentioned in Clause 2 of this Article.

2. The validity of a certificate of sastisfaction of security and order conditions must be defined in the following cases:

a) If a business establishment has a fixed operating duration as referred to by the law or as defined in the documents mentioned in Clause 2 Article 19 of this Decree or the Permit granted by the line authority to that business establishment with fixed operating duration, the validity of Certificate of satisfaction of security and order conditions shall not exceed duration specified in the said documents;

b) If a business establishment engages in a business line with use of industrial explosives for construction of works, exploration and exploitation of minerals or petroleum, the validity of Certificate of satisfaction of security and order conditions must conform to the period specified in the document about such construction of works, exploration and exploitation of minerals or petroleum.

3. If documents/permits prescribed in Clause 2 of this Article are valid for 10 years or more, certificates of satisfaction of security and order conditions shall not have expiry date.

4. Relevant business establishments are responsible for providing documents/permits specifying operating duration to competent police authorities.

As regulated above, the validity of a certificate of sastisfaction of security and order conditions must be defined in the following cases:

- If a business establishment has a fixed operating duration as referred to by the law or as defined in the legitimate documents or the Permit granted by the line authority to that business establishment with fixed operating duration, the validity of Certificate of satisfaction of security and order conditions shall not exceed duration specified in the said documents. To be specific:

+ Business registration certificate;

+ Certificate of enterprise registration;

+ Certificate of investment registration;

+ Certificate of operation registration of enterprise’s branch or affiliate;

+ Certificate of registration of cooperative or cooperative union;

+ Certificate of registration of branch or business location of cooperative or cooperative union;

+ Operation License of competent authority of Vietnam;

+ Certificate of registration of household business;

+ Written approval for the establishment or operations enclosed with written notice of tax code of for-profit administrative unit;

- If a business establishment engages in a business line with use of industrial explosives for construction of works, exploration and exploitation of minerals or petroleum, the validity of Certificate of satisfaction of security and order conditions must conform to the period specified in the document about such construction of works, exploration and exploitation of minerals or petroleum.

Which business lines are required to have security and order guarantee plan in Vietnam?

Pursuant to Clause 1 Article 8 of the Decree 96/2016/ND-CP stipulating business establishments required to have security and order guarantee plan in Vietnam:

- Trading in combat gears;

- Firecracker trading;

- Trading in paintball guns;

- Providing electronic casino game services for foreigners;

- Casino service;

- Betting services;

- Trading in industrial explosives;

- Trading in explosive precursors;

- Business lines with use of industrial explosives and explosive precursors;

- Blasting services;

- Dance club services;

- Accommodation service (if the business establishment is an enterprise);

- Trading in small-size military handguns.
