Which Authority Holds the Jurisdiction to Interpret the Law?
Based on Clause 3, Article 3 of the 2015 Law on Promulgation of Legal Documents, it is stipulated:
Interpretation of the Constitution, laws, and ordinances involves the Standing Committee of the National Assembly clarifying the spirit and content of articles, clauses, and points within the Constitution, laws, and ordinances to ensure accurate understanding, implementation, and uniform application of the law.
According to this regulation, the interpretation of the law is the responsibility of the Standing Committee of the National Assembly.
Additionally, Article 158 of this Law also stipulates: The interpretation of the law is conducted in cases where the provisions of the law have different interpretations in practice.
And the interpretation of the law must comply with the following principles:
- Consistent with the spirit, purpose, requirements, and directives for the promulgation of the Constitution, laws, and ordinances;
- In accordance with the content and language of the Constitution, laws, and ordinances;
- Not to amend, supplement, or introduce new regulations.
