Which are commune-level official positions in Vietnam?

Based on Article 5 of Decree 33/2023/ND-CP on positions and titles:

Article 5. Positions and Titles

  1. Commune-level officials specified in Clause 1, Article 2 of this Decree hold the following positions:

a) Secretary, Deputy Secretary of the Communist Party Committee;

b) Chairman, Vice Chairman of the People's Council;

c) Chairman, Vice Chairman of the People's Committee;

d) Chairman of the Vietnam Fatherland Front Committee;

dd) Secretary of the Ho Chi Minh Communist Youth Union;

e) Chairman of the Vietnam Women's Union;

g) Chairman of the Vietnam Farmers' Union (applicable to communes, wards, and commune-level towns with agricultural, forestry, fishery, and salt production activities and having an organization of the Vietnam Farmers' Union);

h) Chairman of the Vietnam Veterans' Association.

- Secretary, Deputy Secretary of the Communist Party Committee

- Chairman, Vice Chairman of the People's Council

- Chairman, Vice Chairman of the People's Committee

- Chairman of the Vietnam Fatherland Front Committee

- Secretary of the Ho Chi Minh Communist Youth Union

- Chairman of the Vietnam Women's Union

- Chairman of the Vietnam Farmers' Union (applicable to communes, wards, and commune-level towns with agricultural, forestry, fishery, and salt production activities and having an organization of the Vietnam Farmers' Union)

What are the standards for commune-level officials in Vietnam?

Based on Article 8 of Decree 33/2023/ND-CP on the standards for each position of commune-level officials:

[1] Secretary, Deputy Secretary of the Communist Party Committee

- Age: When first holding the position, must be of working age for at least a full term (60 months), with special cases as decided by the competent authority managing officials

- General education level: High school graduate

- Professional and occupational qualifications: University degree or higher. If the Communist Party Charter has different provisions, then follow the provisions of the Party Charter

- Political theory level: Intermediate or equivalent or higher. If the Communist Party Charter has different provisions, then follow the provisions of the Party Charter

- Other standards as prescribed by the Communist Party and the competent authority managing officials.

[2] Chairmen of the Vietnam Fatherland Front Committee, Secretary of the Ho Chi Minh Communist Youth Union, Chairman of the Vietnam Women's Union, Chairman of the Vietnam Farmers' Union, Chairman of the Vietnam Veterans' Association at commune-level:

- Age: As prescribed by law, organizational charter, and regulations of the central political-social organization

- General education level: High school graduate

- Professional and occupational qualifications: University degree or higher. If the law and the organizational charter have different provisions, then follow the provisions of that law and charter

- Political theory level: Intermediate or equivalent or higher. If the law and the organizational charter have different provisions, then follow the provisions of that law and charter

- Other standards as prescribed by the Communist Party, the central political-social organization, and the competent authority managing officials

[3] Chairman, Vice-Chairman of the People's Council; Chairman, Vice-Chairman of the People's Committee:

- Age: When first holding the position, must be of working age for at least a full term (60 months), with special cases as decided by the competent authority managing officials

- General education level: High school graduate

- Professional and occupational qualifications: University degree or higher. If the law has different provisions, then follow the provisions of that law

- Political theory level: Intermediate or equivalent or higher

- Other standards as prescribed by the Law on Organization of Local Government, related laws, the Communist Party, and the competent authority managing officials

What are the duties of commune-level officials in Vietnam in performing their tasks?

Based on Article 9 of the 2008 Law on Officials which stipulates the duties of commune-level officials in performing their tasks as follows:

- Implement correctly, fully, and be responsible for the results of duties and powers assigned.

- Have a sense of organizational discipline; strictly comply with the internal regulations and rules of the agency, organization, unit; report to competent authorities upon detecting any violations of the law within the agency, organization, unit; protect state secrets.

- Be proactive and coordinate closely in performing tasks; maintain unity within the agency, organization, unit.

- Protect, manage, and efficiently and economically use state assets assigned.

- Comply with decisions of superiors. When there is a basis to believe that a decision is contrary to the law, they must promptly report in writing to the decision-maker; if the decision-maker still decides to implement, the decision must be in writing and the implementer must comply but will not be held responsible for the consequences of implementation, and must also report to the immediate superior of the decision-maker. The decision-maker must bear responsibility before the law for their decision.

- Other duties as prescribed by law.
