Whether a Transferred Judicial Officer Is Permitted to Establish a New Judicial Office

Based on Clause 1, Article 28 of Decree 08/2020/ND-CP (Effective from February 24, 2020), it is stipulated that:

- The Enforcement Office can be transferred to other Enforcers who meet the conditions specified in Clause 2 of this Article. The Enforcement Office may only be transferred after it has been operational for at least 02 years, starting from the date of issuance of the Operational Registration Certificate.

- Enforcers who have transferred their Enforcement Office are not allowed to establish or participate in the establishment of a new Enforcement Office within 05 years from the date of transfer. However, they are allowed to practice as Enforcers under the terms of a labor contract.

=> Therefore, according to the above provision, Enforcers are not permitted to establish a new Enforcement Office within 05 years from the date of transfer. After this period, Enforcers are free to establish the Office as per regulations.
