When will the Decree guiding the Law on Medical Examination and Treatment in 2023 be issued in Vietnam?
On January 1, 2024, the Law on Medical Examination and Treatment in 2023 came into effect and replaced the Law on Medical Examination and Treatment in 2009.
The Law on Medical Examination and Treatment in 2023 has the following guiding documents:
- Circular 32/2023/TT-BYT guiding the Law on Medical Examination and Treatment issued by the Minister of Health
- Circular 33/2023/TT-BYT on the List of Group B infectious diseases prioritized for budget allocation for medical examination and treatment activities issued by the Minister of Health
- Circular 30/2023/TT-BYT regulating the list of diseases and conditions that can be examined and treated remotely issued by the Minister of Health
- Circular 28/2023/TT-BYT regulating the scope of medical examination and treatment activities and the professional and technical content of the training program for medical staff working in the health sector of agencies, units, and organizations without establishing medical examination and treatment facilities issued by the Minister of Health
- Circular 27/2023/TT-BYT regulating the standards, functions, tasks, scope of medical examination and treatment activities, and the content of professional and technical training for Community Health Workers; Village Midwives issued by the Minister of Health
Among the guiding circulars of the Law on Medical Examination and Treatment in 2023, there is a reference to Decree 96/2023/ND-CP. However, at the moment, Decree 96/2023/ND-CP has not yet been published. If Decree 96/2023/ND-CP is published, we will update it as soon as possible.

Who are prioritized for medical examination and treatment in Vietnam?
Pursuant to Article 3 of the Law on Medical Examination and Treatment in 2023 stipulating principles of provision of medical services as follows:
Principles of provision of medical services
1. Respect, protect, and treat patients equally, and stop stigma or discrimination towards patients.
2. Give priority to have access to medical services to patients in a state of emergency; children aged under 6 years; pregnant women; people with extremely severe disabilities; people with severe disabilities; people aged 75 years or older; people rendering meritorious services to the revolution, depending on the particular characteristics of each medical establishment.
3. Respect, cooperate with and protect practitioners and other persons on duty at medical establishments.
4. Promptly implement and comply with regulations on professional and technical expertise in healthcare.
5. Comply with the code of professional ethics in the practice of medicine approved by the Minister of Health.
6. Ensure equality and fairness among medical establishments.
As regulations above, entities that are prioritized for medical examination and treatment in Vietnam are:
- Patients in a state of emergency;
- Children aged under 6 years;
