According to Clause 9, Article 2 of Regulation 69-QD/TW in 2022 on disciplinary principles, the handling of Communist Party of Vietnam members is as follows:

Disciplinary Principles

9. Communist Party of Vietnam members who violate the law must be strictly dealt with according to the provisions of the law. Communist Party of Vietnam members who violate the law to the extent that they are held criminally responsible, wanted, or sentenced by the court to a penalty of non-custodial reform or above shall be expelled from the Party. If the punishment is lighter than non-custodial reform, the corresponding Party disciplinary measures shall be applied based on the content, nature, consequences, causes of the violation, and aggravating or mitigating factors. If there is embezzlement of Party or State finances, assets of organizations or individuals, responsibility and compensation must be considered.

Therefore, Communist Party of Vietnam members are expelled from the Party in the following cases:

- Communist Party of Vietnam members who violate the law to the extent that they are held criminally responsible.

- Communist Party of Vietnam members who are wanted.

- Communist Party of Vietnam members who are sentenced by the court to a penalty of non-custodial reform or above.

Based on Clause 3, Article 51 of Regulation 69-QD/TW in 2022 regarding violations of marriage and family regulations:

Violations of marriage and family regulations

In cases where violations mentioned in Clause 1, Clause 2 of this Article result in very serious consequences or violate one of the following cases, the disciplinary measure of expulsion shall be applied:

a) Violating the regulations on prohibited marriages, violating the monogamous marriage regime, affecting family happiness, and causing negative public opinion in society.

b) Coercing the spouse or children to engage in immoral or illegal activities that do not reach the level of criminal responsibility.

c) Refusing or failing to fulfill the obligation to provide support to parents, or failing to fulfill the obligation to provide support to children after divorce according to the provisions of the law.

Therefore, Communist Party of Vietnam members who violate marriage and family regulations are expelled from the Party in the following cases:

[1] Falling under one of the violations that result in very serious consequences:

- Interfering in marriage, divorce, or arranging for underage individuals to get married.

- Evading the duty to care for and support children, exploiting child labor.

- Obstructing non-custodial parents from visiting their children after divorce (excluding cases where parental visitation rights are restricted by court decision).

- Evading or failing to fulfill guardianship obligations after completing the guardianship procedure at the competent authority according to the law.

- Altering, distorting the content, or falsifying documents for the purpose of registering as adoptive parents.

- Failing to register marriage or living with another person as a spouse while having a legal spouse.

- Violating surrogacy laws.

- Violating the act of altering, distorting the content, or falsifying documents for the purpose of registering marriage.

[2] Violating one of the following cases:

- Violating the regulations on prohibited marriages, violating the monogamous marriage regime, affecting family happiness, and causing negative public opinion in society.

- Coercing the spouse or children to engage in immoral or illegal activities that do not reach the level of criminal responsibility.

- Refusing or failing to fulfill the obligation to provide support to parents or failing to fulfill the obligation to provide support to children after divorce according to the provisions of the law.

What rights do Communist Party of Vietnam members have?

Based on Article 3 of the 2011 Constitution of the Communist Party of Vietnam, Party members have the following rights:

Communist Party of Vietnam members have the following rights

1. To be informed and discuss issues related to the Party's political platform, Party Constitution, guidelines, principles, and policies; to participate in voting on Party affairs.

2. To be eligible, nominated, and vote for leadership positions at all levels of the Party in accordance with the regulations of the Central Executive Committee.

3. To criticize and question the activities of Party organizations and members at all levels within the scope of organization; to report, make suggestions to responsible authorities, and request responses.

4. To express opinions when Party organizations evaluate, make decisions, or impose disciplinary actions on themselves.

Preparatory Party members have the same rights as mentioned above, except for the rights to vote, be eligible, and vote for Party leadership positions.

Therefore, Communist Party of Vietnam members have the following rights:

- To be informed and participate in discussions on issues related to the Party's political platform, Party Constitution, guidelines, principles, and policies.

- To vote on Party affairs.

- To be eligible, nominated, and vote for leadership positions at all levels of the Party in accordance with the regulations of the Central Executive Committee.

- To criticize and question the activities of Party organizations and members at all levels within the scope of organization.

- To report, make suggestions to responsible authorities, and request responses.

- To express opinions when Party organizations evaluate, make decisions, or impose disciplinary actions on themselves.

Note: Preparatory Party members have the same rights as Party members, except for the rights to vote, be eligible, and vote for Party leadership positions.
