When an official is demoted, how long is salary raise period prolonged in Vietnam? How long is the time to hold the rank for regular salary increase review for officials in Vietnam?

I am a leading official in a state agency, recently due to misconduct, I was disciplined with demotion. I want to know when being subjected to the disciplinary measure of demotion, how long will salary raise period be prolonged?

Based on Article 82 of the 2008 Law on Cadres and Civil Servants as amended by Article 17 of the 2019 Law on Cadres and Civil Servants and the Law on Public Employees, other provisions concerning disciplined cadres and civil servants are as follows:

1. For cadres or civil servants who are reprimanded or cautioned, their salary raise period will be prolonged for 6 months from the date their disciplining decisions take effect; if being demoted or removed from office, their salary raise period will be prolonged for 12 months from the date their disciplining decisions take effect.

2. Cadres and civil servants who are disciplined will be handled as follows:

a) In case of disciplinary action in the form of a reprimand, warning, or salary reduction, the promotion to a higher position, planning, training, or appointment to a higher position will not be implemented within 12 months from the effective date of the disciplinary decision;

b) In case of disciplinary action in the form of demotion or removal from office, the promotion to a higher position, planning, training, or appointment will not be implemented within 24 months from the effective date of the disciplinary decision;

c) After the time limit specified in points a and b of this clause, if the official or civil servant does not violate to the extent that disciplinary action is required, they may continue to be promoted, planned, trained, or appointed according to the provisions of the law.

3. Cadres and civil servants who are under disciplinary proceedings, investigation, prosecution, or trial are not allowed to run for election, be nominated, appointed, transferred, rotated, seconded, trained, developed, promoted, or dismissed.

4. Cadres and civil servants who are removed from office due to corruption are not allowed to be appointed to leadership or managerial positions.

Therefore, according to the above regulations in Vietnam, when disciplined with demotion, the extension of the salary raise period will be 12 months.

How long is the time to hold the rank for regular salary increase review for officials in Vietnam?

Based on Point a, Clause 1, Article 2 of Circular 08/2013/TT-BNV, the period to hold the rank for regular salary increase review is as follows:

- For the title of senior expert: If not yet at the final salary rank in the senior expert salary table, after holding the rank for 5 years (60 months) in the senior expert salary table, one salary rank will be evaluated for increase;

- For positions and titles requiring training from college level and above: If not yet at the final salary rank in the position or title, after holding the rank for 3 years (36 months) in the position or title, one salary rank will be evaluated for increase;

- For positions and titles requiring training from intermediate level and below and for clerical and service staff: If not yet at the final salary rank in the position or title, after holding the rank for 2 years (24 months) in the position or title, one salary rank will be evaluated for increase.

Therefore, the period to hold the rank for regular salary increase review varies depending on the position or title of the civil servant, ranging from 24 to 60 months in Vietnam.
