According to Article 15 of the 2022 Mobile Police Law (effective from 01/01/2023), the Mobile Police use weapons, explosives, combat gears, vehicles, and technical equipment as follows:

1. When performing independent tasks, Mobile Police officers and soldiers are allowed to use weapons, explosives, and combat gears, and are authorized to use civilian firearms in accordance with the provisions of the Law on Management and Use of Weapons, Explosives, and Combat gears.

2. When performing organized tasks, the use of weapons, explosives, and combat gears by the Mobile Police must comply with the orders of the direct commanding officer. The issuing officer must comply with the provisions of the Law on Management and Use of Weapons, Explosives, and Combat gears, relevant laws, and be responsible for their decisions under the law and to their superiors.

3. The use of vehicles and technical equipment in the performance of Mobile Police duties must be approved by the authorized authority.

4. The use of weapons, explosives, combat gears, vehicles, and technical equipment of the Mobile Police in training and exercises must be approved according to the authorized plan.

What are regulations on mobilization of staffs, vehicles, and civilian equipment of the mobile police in Vietnam?

Article 16 of the 2022 Mobile Police Law regulates themobilization of staffs, vehicles, and civilian equipment of the mobile police as follows:

1. When performing tasks as prescribed in Clause 2 and Clause 3 of Article 9 of this Law, in urgent cases to protect national security, ensure public order and safety, or prevent ongoing or imminent damage to society, Mobile Police officers and soldiers are authorized to mobilize staffs, civilian vehicles, and equipment, as well as the individuals using and operating such vehicles and equipment. In the case of counter-terrorism tasks, the mobilization of staffs, vehicles, and equipment shall be carried out in accordance with the provisions of the Law on Prevention and Combat of Terrorism.

In urgent cases as prescribed in this clause, Mobile Police officers and soldiers may request the assistance of foreign organizations and individuals to perform their tasks in accordance with the provisions of Vietnamese law and international treaties of which the Socialist Republic of Vietnam is a member.

2. The authority to mobilize staffs, civilian vehicles, and equipment of agencies, organizations, and individuals is as follows:

a) Officers and non-commissioned officers of the Mobile Police in operational duties are authorized to mobilize civilians, civilian vehicles, and equipment when performing independent tasks;

b) The direct commanding officer of the Mobile Police at the scene decides to mobilize staffs, civilian vehicles, and equipment when performing organized tasks.

3. Mobile Police officers and soldiers who mobilize staffs, civilian vehicles, and equipment are responsible for returning them immediately after the urgent situation ends. In case the mobilized individuals, vehicles, and equipment suffer damage while performing their tasks, they shall be entitled to benefits, policies, and compensation in accordance with the provisions of Clause 4 of Article 32 of this Law; the unit with mobilized officers and soldiers is responsible for resolving compensation matters in accordance with the provisions of relevant laws.
