From January 10, 2025, what are the documents required to prove legal residence for permanent residence registration in Vietnam?

Pursuant to Clause 2, Article 5 of Decree 154/2024/ND-CP, regulations on documents, materials, and information proving legal residence:

Article 5. Documents, materials, and information proving legal residence

  1. Citizens provide information proving legal residence to the residency registration office when submitting the residency registration application. The residency registration office is responsible for extracting this information from electronic identification cards, electronic identification accounts on the national identification system, or in the National Database on Population, the Database on Residency, and the Electronic Data Management System for organizations and individuals on the National Public Service Portal, the Ministry and Provincial administrative procedure resolution information systems, or other national or specialized databases.

If information proving legal residence cannot be retrieved from the database, information systems, or national identification applications, the residency registration office is responsible for verifying, checking to resolve residence procedures. Citizens are required to provide copies, electronic versions, or printouts of one of the documents proving legal residence upon request by the residency registration office.

  1. Documents proving legal residence for permanent registration include one of the following:

a) Documents certifying land use rights, ownership of assets attached to land issued by competent authorities throughout different periods according to land and housing laws;

b) Housing construction permits or temporary construction permits for cases requiring a construction permit according to construction law;

- Documents certifying land use rights and ownership of assets attached to land issued by competent authorities throughout the years according to land and housing laws

- Housing construction permits or temporary housing construction permits for cases requiring construction permits according to construction law

- Documents for the purchase and sale of state-owned housing or documents on the pricing, liquidation of housing attached to homestead land under state ownership as per legal regulations

- Contracts for purchasing housing or documents proving the handover or receipt of housing from real estate businesses investing in construction for sale

- Documents related to purchasing, renting, renting to buy, gifting, inheriting, contributing capital, or exchanging housing in compliance with land and housing laws

- Documents on awarding gratitude houses, charity houses, solidarity houses, or providing housing and homestead land to individuals or households

- Court documents or competent state agency decisions granting lawful ownership of the house

- Documents proving the mortgage or pledge of ownership rights to legal residence

- Confirmation from the commune-level People's Committee about stable and dispute-free housing and homestead land not located in areas prohibiting new permanent registration

- Documents proving registration or inspection of owned vehicles, confirmation of regular parking spaces, except where registration of regular parking spaces is not required

- Contracts or documents for renting, borrowing, granting residence that are notarized or authenticated according to law

- Other types of documents for considering the issuance of land use rights certificates, ownership of other assets attached to land according to the land and housing laws through different periods

What is the minimum housing area required for permanent residence registration at a legal residence rented, borrowed, or utilized with permission in Vietnam?

Pursuant to Article 20 of Residence Law 2020, conditions for permanent residence registration are as follows:

Article 20. Conditions for permanent residence registration

  1. Except as provided in Clause 2 of this Article, citizens may register for permanent residence at a legal residence rented, borrowed, or used with permission when the following conditions are met:

a) Approval from the legal residence owner is obtained for the registration of permanent residence at the rented, borrowed, or used residence, and approval from the household head if registering in the same household;

b) Compliance with the minimum housing area condition prescribed by the Provincial People's Council, but not less than 8 square meters of floor space per person.

According to the above regulation, the minimum housing area required for permanent residence registration at a legal residence that is rented, borrowed, or used with permission is determined by the Provincial People's Council but must not be less than 8 square meters of floor space per person.
