What is the public non-business unit in Vietnam?
Pursuant to Clause 1 Article 9 of the Law on Public Employees in 2010, public non-business unit is an organization established under law by a competent state agency, a political organization or a socio-political organization, having the legal person status and providing public services and serving state management work.
Furthermore, according to Article 3 of Decree 120/2020/ND-CP (effective from December 1, 2020), the establishment, reorganization, and dissolution of public non-business units, public non-business units abroad are defined as public non-business units belonging to ministries, equivalent agencies, or agencies under the Government, established by competent state authorities, with legal personality, seal, separate bank accounts as regulated by law, and headquartered overseas.
Pursuant to Article 2 of the Law on Public Employees in 2010, public employees are Vietnamese citizens recruited according to working positions, working in public non-business units under working contracts and salaried from salary funds of public non-business units in accordance with law.

What is the classification of public non-business unit units in Vietnam?
Pursuant to Clause 2 Article 9 of the Law on Public Employees in 2010, public non-business units include:
Public non-business units assigned with absolute autonomy in task performance, finance, apparatus organization and personnel (below referred to as autonomous public non-business units);
Public non-business units not yet assigned with absolute autonomy in task performance, finance, apparatus organization and personnel (below referred to as non-autonomous public non-business units).
Specifically, Article 2 of Decree 120/2020/ND-CP defines public non-business units as follows:
Public non-business units (excluding those belonging to the Ministry of Public Security and the Ministry of National Defense) within the jurisdiction of ministries or equivalent agencies, including:
Public non-business units belonging to ministries (including units within the organizational structure of the ministry, units directly under the ministry, and units located overseas);
Public non-business units belonging to a general department or equivalent organization under a ministry (hereinafter referred to as a ministry's general department);
Public non-business units belonging to a department or equivalent sub-department under a ministry's general department;
Public non-business units belonging to an office under a ministry;
Public non-business units belonging to a sub-department under a ministry's general department.
Public non-business units under a government agency (including those located overseas).
Public non-business units established by the government or the Prime Minister, which are not considered public non-business units.
Public non-business units within the jurisdiction of provincial-level People's Committees of centrally governed cities and provinces, including:
Public non-business units under provincial People's Committees;
Public non-business units under specialized agencies of provincial People's Committees (referred to as departments);
Public non-business units under a sub-department or equivalent organization of a department;
Public non-business units under other administrative organizations of provincial People's Committees.
Public non-business units under district-level People's Committees, urban districts, towns, and cities under the jurisdiction of provinces or central-affiliated cities.
