According to Article 7 of Circular 98/2021/TT-BCA (Effective from 03/12/2021), the citizen reception process of the Police is as follows:

1. When citizens come to make complaints, accusations, suggestions, reflections, the officer in charge of receiving citizens is responsible for receiving citizens according to regulations, except for cases specified in Article 9 of the Law on Citizen Reception; requesting citizens to clearly state their full name, address, or present personal identification documents (if any); if the person is authorized, the legal representative must have legitimate documents as prescribed.

2. Explain the rights and obligations of citizens when carrying out complaints, accusations, suggestions, reflections, and request citizens to provide information, documents, and evidence to the Police in accordance with the law.

3. In case citizens come to make complaints, accusations, suggestions, reflections without a written complaint, accusation, suggestion, or reflection, the officer in charge of receiving citizens shall guide them in writing the complaint. In case citizens are unable to write the complaint themselves, the officer in charge of receiving citizens shall record the content of the complaint, accusation, suggestion, reflection accurately and completely in writing and request the citizen to sign or make a mark.

In case the presentation is unclear or incomplete, the officer in charge of receiving citizens shall request the citizen to supplement the complaint, accusation, suggestion, reflection or provide additional information, documents, and evidence for verification.

4. In case the content of the complaint, accusation, suggestion, reflection falls under the jurisdiction and responsibility of multiple different agencies, organizations, units, the officer in charge of receiving citizens shall guide the citizen to write a separate complaint and send it to the appropriate agency, organization, unit authorized to resolve it according to the law.

5. In case the complaint, accusation, suggestion, reflection falls under the jurisdiction of the same-level Chief, the officer in charge of receiving citizens shall receive the complaint and related information, documents, and evidence for processing according to the law.

6. In case the complaint, accusation, suggestion, reflection does not fall under the jurisdiction of the same-level Chief, the officer in charge of receiving citizens shall guide the citizen to send the complaint, accusation, suggestion, reflection to the competent agency, person according to the law (except for denunciations, crime reports, suggestions for prosecution).

7. In case the complaint, accusation, suggestion, reflection falls under the jurisdiction of the lower-level Chief directly, but exceeds the prescribed time limit without being resolved, the officer in charge of receiving citizens shall receive the complaint, report to the same-level Chief for resolution or propose the Chief of the competent agency, unit to resolve it.

8. When receiving the complaint and related information, documents, and evidence regarding the content of the complaint, accusation, suggestion, reflection, the officer in charge of receiving citizens must verify the validity of the information, documents, and evidence and must make a receipt for the reception, with the signature of the receiving officer. The receipt shall be made in two copies, one of which shall be given to the person making the complaint, accusation, suggestion, reflection.

9. After receiving the complaint and the information, documents, and evidence provided by the complainant, accuser, suggester, reflector, the officer in charge of receiving citizens must record in the citizen reception book or update it in the computer database system.
