On February 26, 2025, the Government of Vietnam issued Decree 40/2025/ND-CP prescribing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade.
Pursuant to Article 3 of Decree 40/2025/ND-CP, the organizational structure is regulated as follows:

What are duties and powers of the Ministry of Industry and Trade of Vietnam regarding commerce and domestic market?
Pursuant to Clause 14 Article 2 of Decree 40/2025/ND-CP, the duties and powers of the Ministry of Industry and Trade regarding commerce and the domestic market are prescribed as follows:
- Organize the implementation of mechanisms and policies for the development of commerce and the domestic market; develop commerce and ensure the balance of supply and demand of goods, essential goods for mountainous, island, remote, rural, border areas, and ethnic minorities according to legal regulations; regarding transaction methods and types of business as per legal regulations.
- Preside over and cooperate with ministries and central authorities in regulating the distribution, circulation of goods.
- Preside over and cooperate with ministries, central authorities, and local authorities in managing and developing commercial services according to legal regulations.
- Preside over and cooperate with ministries, central authorities, and local authorities in formulating policies for the development of commercial infrastructure (including markets, supermarkets, commercial centers, shopping centers, auction centers, logistics centers, warehouses, trade fair centers, exhibitions, retail stores) following legal regulations.
- Oversee state management for the trading of goods through the Commodity Exchange.
Is the Minister of Industry and Trade a member of the Government of Vietnam?
Pursuant to Article 99 of the 2013 Constitution:
Article 99.
- Ministers, Heads of ministerial-equivalent agencies are members of the Government of Vietnam and are the heads of ministries, ministerial-equivalent agencies, leading the work of ministries, ministerial-equivalent agencies; responsible for state management in assigned sectors, fields; organizing the implementation and monitoring the enforcement of laws related to assigned sectors, fields nationwide.
- Ministers, Heads of ministerial-equivalent agencies report their work to the Government of Vietnam, the Prime Minister of the Government of Vietnam; implement policies reporting to the People on important issues under their management responsibility.
According to the above regulation, the Minister is a member of the Government of Vietnam and is the head of ministries, ministerial-equivalent agencies, leading the work of ministries, ministerial-equivalent agencies.
The Minister is responsible for state management in assigned sectors and fields; organizing the implementation and monitoring compliance with laws related to the sectors and fields nationwide.
In summary, the Minister of Industry and Trade is a member of the Government of Vietnam.
