According to Clause 4 Article 3 of Decision 40/2022/QĐ-UBND on the functions, tasks, powers, and organizational structure of the Hanoi Department of Labor, War Invalids and Social Affairs, the number of deputy positions of administrative organizations and public non-profit units under the Hanoi Department of Labor, War Invalids and Social Affairs is as follows:
4. The number of deputy positions of the heads of administrative organizations and public non-profit units under the Hanoi Department of Labor, War Invalids and Social Affairs shall be implemented in accordance with the provisions of Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government and Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on the establishment, reorganization, and dissolution of public non-profit units.

What are regulations on the staffing of the Hanoi Department of Labor, War Invalids and Social Affairs in Vietnam?
According to Article 4 of Decision 40/2022/QĐ-UBND on the functions, tasks, powers, and organizational structure of the Hanoi Department of Labor, War Invalids and Social Affairs, the staffing of the Hanoi Department of Labor, War Invalids and Social Affairs is as follows:
a) The number of civil servants and the number of employees in public non-profit units under the Hanoi Department of Labor, War Invalids and Social Affairs shall be assigned based on the positions, linked to the functions, tasks, scope of activities, and within the total number of civil servants and the number of employees in the administrative agencies, public non-profit units of the City assigned or approved by the competent authority.
b) Based on the functions, tasks, organizational structure, and list of positions, civil servant ranks, and professional titles for civil servants approved by the competent authority, the Hanoi Department of Labor, War Invalids and Social Affairs shall, every year, lead and coordinate with the Hanoi Department of Internal Affairs to develop a plan for the number of civil servants and the number of employees in the administrative agencies and public non-profit units to submit to the Hanoi People's Committee for submission to the competent authority for consideration and decision in accordance with the regulations to ensure the performance of the assigned tasks.

According to Article 5 of Decision 40/2022/QĐ-UBND on the functions, tasks, powers, and organizational structure of the Hanoi Department of Labor, War Invalids and Social Affairs, the following transition clause is provided:
For those who have been appointed to the position of head or deputy head of the units under the Department, after the reorganization, they no longer hold the leadership position or are appointed to a new position with a lower leadership position allowance than the old leadership position allowance, they shall be entitled to retain the leadership position allowance according to the provisions of Decision No. 140/2009/QĐ-TTg dated December 31, 2009 of the Prime Minister on the retention of leadership position allowance for leadership positions during the process of restructuring and streamlining the organizational structure.

The Hanoi Department of Labor, War Invalids and Social Affairs is a legal entity, has a seal and account in accordance with the law; is under the leadership, management of the Hanoi People's Committee in terms of organization, staffing, and work; and is also under the leadership, inspection, and guidance of the Ministry of Labor, War Invalids and Social Affairs in terms of professional and technical matters.
