On November 27, 2023, the Government of Vietnam issued Decree 81/2023/NĐ-CP, which stipulates the functions, powers, and organizational structure of the Government Inspectorate.

Article 1 of Decree 81/2023/NĐ-CP stipulates the position and functions of the Government Inspectorate as follows:

Position and functions

The Government Inspectorate is a ministerial-level agency under the Government, responsible for the management of state affairs in the field of inspection, reception of people, handling of complaints, denunciations and prevention and combat of corruption and negativity within the whole country; carry out inspection activities, receive people, handle complaints, denunciations and prevention and combat of corruption and negativity according to the law.

Therefore, the Government Inspectorate is a ministerial-level agency under the Government, performing the following functions:

- Management of state affairs in the field of inspection, reception of people, handling of complaints, denunciations and prevention and combat of corruption and negativity within the whole country;

- Inspection activities, reception of people, handling of complaints, denunciations and prevention and combat of corruption and negativity according to the law.

Article 3 of Decree 81/2023/NĐ-CP stipulates the organizational structure of the Government Inspectorate as follows:

Administrative organizations include:

- Legal Department.

- Organizational and Personnel Department.

- International Cooperation Department.

- Planning - General Department.

- Office.

- Inspection, Handling Complaints and Denunciations Department for the Economic Sector (Department I).

- Inspection, Handling Complaints and Denunciations Department for the Internal Affairs and General Economic Sector (Department II).

- Inspection, Handling Complaints and Denunciations Department for the Culture and Society Sector (Department III).

- Inspection, Handling Complaints and Denunciations Department for Region 1 (Department I).

- Inspection, Handling Complaints and Denunciations Department for Region 2 (Department II).

What are duties and powers of the Government Inspectorate in the field of anti-corruption and negativity in Vietnam?

Clause 7 Article 2 of Decree 81/2023/NĐ-CP stipulates the duties and powers of the Government Inspectorate in the field of anti-corruption and negativity as follows:

- Organize, direct, and guide the implementation of the provisions of the law on anti-corruption and negativity within its authority or according to the direction of the Government, the Prime Minister, and anti-corruption and negativity in the inspection work;

- Inspect cases with signs of corruption within its authority; inspect the implementation of the law on anti-corruption and negativity at ministries, government agencies under the Government, provincial People's Committees, businesses, and social organizations in the non-state sector within its authority or at the direction of the Prime Minister;

- Proactively coordinate with agencies and organizations in detecting acts of corruption and negativity; inspect cases with signs of corruption and negativity within its authority or at the direction of the Prime Minister; urge the handling of persons who have committed acts of corruption and negativity in accordance with the law and in accordance with the delegation of cadre management of the Party and Government;

- Control the assets and income of persons with positions of authority in agencies, organizations, and units within its authority;

- Build, manage, exploit, and protect the national database on asset and income control; monitor, evaluate the situation of corruption and negativity and the work of anti-corruption and negativity at ministries, departments, localities, and the non-state sector;

- Coordinate with the State Audit, the Ministry of Public Security, the Ministry of Defense, the Supreme People's Procuracy, the Supreme People's Court, and the Central Internal Affairs Agency in providing, exchanging information, documents, and experience on anti-corruption and negativity work; summarize, evaluate, forecast the situation of corruption and negativity and recommend policies and solutions for anti-corruption and negativity.

Note: Decree 81/2023/NĐ-CP takes effect on December 1, 2023.
