What does the dossier for renunciation of Vietnamese nationality include?
According to Clause 1, Article 28 of the Vietnamese Nationality Law 2008, the dossier for renunciation of Vietnamese nationality includes:
- Application for Renunciation of Vietnamese nationality;
- Personal information declaration form;
- Copy of Vietnamese Passport, Identity Card or other documents stipulated in Article 11 of the Vietnamese Nationality Law 2008;
- Judicial record issued by a competent Vietnamese authority. The judicial record must be issued no more than 90 days before the date of application submission;
- Documents certifying that the individual is undergoing procedures for acquiring foreign nationality, except where the law of that country does not require such documents;
- Certificate of no tax arrears issued by the Tax Department where the applicant resides;
- For those who were previously officials and public employees or served in the Vietnamese armed forces and have retired, resigned, been dismissed, removed from office, or discharged within the last 5 years, a certificate from the agency, organization, or unit that made the decision to retire, resign, dismiss, remove from office, or discharge, confirming that the renunciation of Vietnamese nationality does not harm the national interests of Vietnam.
Who is not eligible to apply for renunciation of Vietnamese Nationality?
Clause 2, Article 27 of the Vietnamese Nationality Law 2008 stipulates the grounds for renunciation of Vietnamese nationality as follows:
Grounds for Renunciation of Vietnamese nationality
- Vietnamese citizens who apply for renunciation of Vietnamese nationality to acquire foreign nationality may renounce Vietnamese nationality.
2. An applicant for renunciation of Vietnamese nationality is ineligible for renunciation in the following cases:
a) Owing taxes to the State or having financial obligations to agencies, organizations, or individuals in Vietnam;
b) Under criminal prosecution;
c) Serving a sentence or a court decision issued by a Vietnamese court;
d) Being detained pending sentence execution;
dd) Serving a decision to apply administrative measures in education institutions, rehabilitation centers, or reform schools.
An applicant for renunciation of Vietnamese nationality is ineligible if doing so harms the national interests of Vietnam.
Officials, and those serving in the Vietnamese armed forces are ineligible for renunciation of Vietnamese nationality.
The Government of Vietnam stipulates specific conditions for renunciation of Vietnamese nationality.
Hence, individuals ineligible for renunciation of Vietnamese nationality include:
- Owing taxes to the State or having financial obligations to agencies, organizations, or individuals in Vietnam;
- Under criminal prosecution;
- Serving a sentence or a court decision issued by a Vietnamese court;
- Being detained pending sentence execution;
- Serving a decision to apply administrative measures in education institutions, rehabilitation centers, or reform schools.
Who is exempt from identity verification procedures when applying for renunciation of Vietnamese nationality?
Article 30 of the Vietnamese Nationality Law 2008 stipulates that the following individuals are exempt from identity verification procedures when applying for renunciation of Vietnamese nationality:
- Individuals under 14 years old;
- Individuals born and residing abroad;
- Individuals who have resided abroad for 10 years or more;
- Individuals who have emigrated under family reunification schemes.
