What is summary of proposals to remove property from the property distribution from the Ministry of National Defense in Vietnam?
Pursuant to Article 8 of Circular 126/2020/TT-BQP regulating summary of proposals to remove property from the property distribution from the Ministry of National Defense as follows:
1. Before October 15 every year, reporting units proposing removal from distribution and disposal of assets according to Form No. 02 in Appendix II issued with this Circular report to the Ministry of National Defense (through the Department of Planning and Investment, Department of Finance), and at the same time send related content to specialized agencies and units:
a) Assets are technical equipment; Ammunition and toxic chemicals: sent to the General Staff (through the Department of Military Forces), the General Department of Engineering and relevant specialized agencies and units;
b) Assets that are technical equipment, supplies and goods to ensure technical work: sent to the General Department of Engineering and relevant specialized agencies and units;
c) Assets being equipment, supplies and goods to ensure Party and Political work: sent to the General Department of Politics;
d) Assets being equipment, supplies and goods to ensure logistics work: sent to the General Department of Logistics;
d) Assets being equipment, supplies and goods to ensure defense industry: sent to the General Department of Defense Industry.
2. Before November 15 every year, the General Department of Politics, the General Department of Logistics, the General Department of Engineering, the General Department of Defense Industry and other specialized branches shall summarize and propose removal from the distribution and disposal of their assets. Units report to the Ministry of National Defense (through the Department of Planning and Investment and the Department of Finance).
3. Before December 15 every year, the Department of Planning and Investment shall preside over and coordinate with relevant authorities to synthesize, propose and develop a plan for asset staffing and report to the Minister of National Defense for approval.
What is revision of the proposal to remove property from the property distribution from the Ministry of National Defense in Vietnam?
Pursuant to Article 9 of Circular 126/2020/TT-BQP regulating revision of the proposal to remove property from the property distribution from the Ministry of National Defense as follows:
1. Organizing a revision:
a) Based on the plan to remove assets from the distribution approved by the Minister of National Defense, the unit plans and establishes a quarterly revision team.
10 days in advance, up to the date of the revision, the unit in charge of the revision shall send the revision plan, revision content and related documents (if any) to the competent authorities specified in Clause 1, Article 10 This Circular;
b) The agencies specified in Clause 1, Article 10 of this Circular revision and compare with management records, instructions, and industry regulations to appoint officials to join the revision Team;
In cases where agencies and units do not send officers to join the revision team, there must be instructions and direction on revision methods according to the functions and tasks assigned by the Ministry of National Defense;
c) The investigation recommends removing assets from the distribution that must be recorded; The content of the Minutes must clarify the unit's requests and recommendations regarding quantity, type, method, treatment plan, guarantee conditions, processing time, items that can be recovered and reused, and scrap proposed to be sold after processing;plan for asset staffing and report to the Minister of National Defense for approval.
d) Pursuant to regulations, professional guidance, and industry charters of superior management agencies, Commanders of agencies and units on duty with the Ministry of National Defense shall direct the Asset Handling Council and authorized agencies and units. Assign storage, management, and use of assets, inspect, classify, evaluate the quality of assets, propose removal from distribution, and make records according to regulations;
d) In case the assets proposed to be removed from the distribution and handled are in small quantity and scattered in many places, the composition and method of revision shall be decided by the Commander of the agency or unit under the Ministry of National Defense and shall be responsible Responsible to the Minister of National Defense.
2. Duties of the Investigation Team:
a) Firmly grasp the content of the unit's removal from the distribution plan, evaluate the authenticity of the unit's removal from the distribution plan, and ensure that the competent authority decides on the accurate and correct removal from the distribution policies and regulations of relevant laws;
b) During the revision process, the revision team must revision the reality at the unit and comment on the accuracy and compatibility between the revision reality and the unit's proposal. Members are representatives of specialized agencies and units responsible for clarifying the contents of the fields assigned to monitor and manage and propose to competent authorities for removal from the distribution;
c) Advise and propose to competent authorities to decide on methods of handling assets to ensure accuracy and compliance with current law;
d) Guide units to implement the work of removing from distribution and handling assets, propose measures to overcome limitations and weaknesses in the management and use of assigned state assets;
d) Summarize the results of the revision , prepare a revision record, the content includes: Results of the revision at the request of the unit, recommendations of members of the revision team on removing assets from distribution, proposals Method of handling assets and reporting to competent authorities for consideration, decision on removal from distribution and decision on asset disposal;
e) For ammunition and toxic chemicals, in addition to the inspection contents specified in Point dd of this Clause, the Ministry of National Defense Inspection Team chaired by the General Department of Engineering in coordination with the Department of Finance, Department of Planning and Investment, Department of Military Forces, Department of Operations evaluate the unit's handling plan, make a record and propose to the Chief of General Staff to decide to remove them from the distribution, handle and approve the handling plan.
3. No later than 03 working days from the date of completion of the revision, the agency or unit in charge of the revision shall send the revision minutes to the agencies and units specified in Clause 1, Article 10 of this Circular.
