In Item dd Subsection 2 Section III Plan to reduce and simplify regulations related to business activities within the scope of management functions of the Ministry of Planning and Investment issued together with Decision 1505/QD-TTg In 2022, regulations on administrative procedures for registering the establishment of branches, representative offices, and business locations of cooperatives are simplified as follows:
Administrative procedure group: Registration to establish branches, representative offices, and business locations of cooperatives (2.002123) and Registration to establish branches, representative offices, and business locations of cooperatives (2.002013)
- Content reduced and simplified:
+ Merge 02 administrative procedures into 01 administrative procedure "Registering the operation of branches and representative offices of cooperative economic organizations that have legal status; Notice of establishment of business locations of cooperative economic organizations that have legal status".
+ Abolish the requirement to notify the Business Registration Authority of where the head office is located when a branch or representative office is located in a district or province or city other than where the cooperative/cooperative union is headquartered.
+ Remove the application components "Valid copy of cooperative registration certificate, cooperative union", "Written decision of the board of directors on appointing a representative of the branch, representative office, business location ” of Cooperative/cooperative union.
Reason:
+ Administrative procedures for cooperative unions carry out the decentralization of authority to resolve administrative procedures to the Finance - Planning Department under the district-level People's Committee according to the plan approved in Decision No. 1015/QD-TTg dated August 30, 2022 of the Prime Minister.
+ Reduction of unnecessary sequences and components of documents to save time and costs of implementing administrative procedures of cooperative economic organizations that have legal status.
- Recommendations for implementation:
+ Development of the Law on Cooperative Economic Organizations and documents under the Law to replace the 2012 Law on Cooperatives and related documents.
+ Implementation roadmap: Period 2022 - 2023.

+ Amend the time limit for notification of capital contribution, share purchase, and business establishment of cooperative economic organizations that have legal status: Reduced from 15 days from the date of capital contribution, share purchase, and business establishment to 10 days from the date of contribution capital, buying shares, establishing a business.
Reason:
+ Administrative procedures for cooperative unions carry out the decentralization of authority to resolve administrative procedures to the Finance - Planning Department under the district-level People's Committee according to the plan approved in Decision No. 1015/QD-TTg dated August 30, 2022 of the Prime Minister.

- Content reduced and simplified:
+ Combine 02 administrative procedures into 01 administrative procedure "Register when cooperative economic organizations that have legal status divide".
+ Clarify the method of dividing cooperative economic organizations that have legal status.
+ Clearly define the order of implementation, rights and obligations of cooperative economic organizations that have legal status during the division process.
+ Clearly define the rights and obligations of the Business Registration Authority.
Reason:
+ Administrative procedures for cooperative unions carry out the decentralization of authority to resolve administrative procedures to the Finance - Planning Department under the district-level People's Committee according to the plan approved in Decision No. 1015/QD-TTg dated August 30, 2022 of the Prime Minister.
+ Cooperative economic organizations that have legal status can easily learn and comply with legal regulations on their rights and obligations, shortening the time to prepare documents. For the Business Registration Authority, there are additional grounds to review and process documents, facilitate the process of considering and resolving administrative procedures, and ensure document processing time.
