What is removal of documents and objects containing state secrets in the People's Public Security in Vietnam?

Pursuant to Article 7 of Circular 104/2021/TT-BCA regulating removal of documents and objects containing state secrets from storage as follows:

1. Taking documents and objects containing state secrets out of storage to serve domestic work must be directly managed by the head or authorized deputy of the head of the People's Public Security unit allowed by state secrets.

2. Taking documents and objects containing state secrets out of storage to serve work abroad must be permitted by the Minister of Public Security or an authorized Deputy Minister and must be reported to the Head of the delegation.

3. When taking documents or objects containing state secrets out of storage, officers and soldiers must request written permission from the competent person specified in Clauses 1 and 2 of this Article. A written request for permission to take documents and objects containing state secrets out of storage for domestic or foreign work must clearly state full name, position, and work unit; type name, summary of content, confidentiality level of documents and objects containing state secrets; uses; time and place of work; measures to protect state secrets.

4. While taking documents and objects containing state secrets out of storage, if detecting that state secrets are leaked or lost, the person carrying the documents or objects containing state secrets must immediately report to the head of the People's Public Security unit directly manages the case and the head of the working group to take measures to handle and overcome the consequences.

5. Documents and objects containing state secrets taken out of storage must be stored, contained, and transported by means and equipment to ensure safety by the head of the People's Public Security unit managing state secrets. regulations and must be protected during removal from storage. At the end of the task, you must report to the competent person allowing documents and objects containing state secrets to be taken out of the storage place regarding the management and use of state secrets and return them to the unit.

What is providing state secrets to Vietnamese agencies assigned to perform tasks directly related to state secrets in the People's Public Security?

According to Article 8 of Circular 104/2021/TT-BCA regulating provision and transfer of state secrets to Vietnamese agencies, organizations and people assigned to perform tasks directly related to state secrets as follows: 

1. The authority to decide on the provision and transfer of state secrets to Vietnamese agencies, organizations and people assigned to perform tasks directly related to state secrets is prescribed as follows:

a) Competent persons specified in Clause 1, Article 4 of this Circular decide on the provision and transfer of State secrets classified as Top Secret;

b) Competent persons specified in Clause 2, Article 4 of this Circular decide on the provision and transfer of state secrets of the Top Secret or Secret level.

2. Agencies and organizations requesting the provision and transfer of state secrets must send a document to the person competent to decide on the provision and transfer of state secrets. The written request must clearly state the name of the agency or organization; representatives of agencies and organizations; State secrets requested to be provided or transferred; purpose of use and commitment to protect state secrets.

3. The person requesting the provision and transfer of state secrets must send a document to the person with authority to decide on the provision and transfer of state secrets. The written request must clearly state full name; Citizen Identification Number, Identity Card, Passport, People's Police Identification Number or ID card number issued by the People's Army; contact address; workplace; State secrets requested to be provided or transferred; purpose of use and commitment to protect state secrets.

4. In case of refusal to provide or transfer state secrets, the person with authority to decide on the provision or transfer of state secrets must respond in writing and clearly state the reason.
