In Article 1 of Circular 05/2022/TT-BKHDT (effective from July 20, 2022), there are regulations on position and function of the Department of Planning and Investment as follows:

Article 1. Position and functions

1. The Department of Planning and Investment is a specialized agency under the Provincial People's Committee that performs the function of advising and assisting the Provincial People's Committee in state management of planning, development investment and planning including: planning; socio-economic development plan; public investment plan; mechanisms and policies in economic fields, attracting investment resources, restructuring the economy, implementing new economic models, new business methods, implementing regional and inter-regional development coordination; domestic investment, foreign investment in the locality; Managing official development assistance (ODA), preferential loans from donors and non-refundable aid sources that are not part of official development assistance from foreign agencies, organizations and individuals outside; Bidding; business registration within the locality; synthesize and unify the management of issues of enterprises, collective economies, cooperatives, private economies, households and other economic organizations; Organize the provision of public services within the scope of state management of the Department according to the provisions of law.

2. The Department of Planning and Investment has legal status, its own seal and account; Subject to the direction and management of organization, staffing and work of the Provincial People's Committee; At the same time, it is subject to the direction, guidance, inspection, and professional examination of the Ministry of Planning and Investment.

What are duties and powers of the Department of Planning and Investment in submitting contents to the Provincial People's Committee in Vietnam?

In Clause 1, Article 2, Circular 05/2022/TT-BKHDT (effective from July 20, 2022) stipulates duties and powers of the Department of Planning and Investment in submitting contents to the Provincial People's Committee are as follows:

1. Submit to the Provincial People's Committee:

a) Draft plan to implement provincial planning; the province's 5-year and annual socio-economic development plan, expected 5-year and annual public investment capital allocation plan from the central budget and local budget; investment promotion plan, annual investment promotion program, list of projects to attract local investment; the province's main socio-economic balances, including the balance of public investment capital; programs and plans to implement the province's sustainable development and green growth goals; plans and implementation status of national target programs; programs and measures to organize the implementation of state administrative reform tasks and improve the investment and business environment in the fields within the scope of assigned state management;

b) Draft an action program to implement the socio-economic development plan according to the Resolution of the Provincial People's Council and be responsible for monitoring and summarizing the implementation of monthly, quarterly and 6-month plans, yearly and five years to report to the Provincial People's Committee to operate and coordinate the implementation of the main socio-economic balances of the province;

c) Draft programs and plans to arrange and innovate the development of State-owned enterprises and enterprises with State capital contributed by local management; management mechanism for State-owned enterprises and enterprises with State capital contribution; Draft programs, plans, projects to support the development of small and medium-sized enterprises, private enterprises (including innovation programs, creative startups), development of cooperatives, household businesses five and five years in the province; draft plan to improve the business investment environment index and enhance provincial competitiveness;

d) Draft program decisions and measures to organize the implementation of administrative reform tasks in the field of planning and investment under the management of the Department according to the provisions of law and decentralization of the Ministry of Planning and Investment;

d) Draft decision specifying the functions, tasks, powers and organizational structure of the Department; draft decision to establish, reorganize, and dissolve public service units of the Department according to the provisions of law;

e) Draft document approving investment policies, approving investment policy adjustments, approving investors, approving investment policies and approving investors as assigned by the People's Committee at the level province for projects under the authority of investment policy approval and investor approval of the Provincial People's Committee according to investment laws; draft list of investment projects using land; draft preliminary requirements on capacity and experience; Plan to organize investor selection based on results of preliminary assessment of capacity and experience for investment projects using land;

g) Draft decision on decentralization and authorization of state management tasks in the field of planning and investment to departments, branches and branches of district-level People's Committees.
