What is organizational structure of a ministry of Vietnam?

Pursuant to Article 17 of the Decree 123/2016/NĐ-CP stipulating organizational structure of a ministry of Vietnam as follows:

1. Organizational structure of a ministry consists of:

a/ Departments;

b/The Office;

c/ The Inspectorate;

d/ Bureaus/agencies/authorities (if any);

dd/ General departments (if any);

e/ Public non-business units.

2. Public non-business units shall be prescribed in the decree defining the functions, tasks and powers and organizational structure of each ministry, including:

a/ Sector or field strategy and policy research units;

b/ Newspapers; journals; information centers;

c/ Schools or centers for training and retraining of cadres, civil servants and public employees; institutes of the ministry.

3. The number of deputy heads of the Office, the Inspectorate, a department, bureau/ agency/authority, general department or public non-business unit must comply with the Law on Organization of the Government.

What is organizational structure of departments of a ministry of Vietnam?

Pursuant to Article 18 of the Decree 123/2016/NĐ-CP (amended by Article 1 of the Decree 101/2020/NĐ-CP) stipulating organizational structure of departments of a ministry of Vietnam as follows:

1. A department is an institution of a ministry, functioning to give general or specialized advices on the state management of sectors or fields or advice on internal administration work of the ministry.

2. A department has no legal entity status, its own seal and account. The director of a department may only sign documents under the order of the Minister to guide, settle and notify professional issues related to the functions and tasks of his/her department.

3. No divisions may be organized within a department. If the department has multiple areas of responsibility and the workload given by assigned by competent authorities, which necessitates the assignment of 30 or more civil servants (hereinafter referred to as civil servant payrolls), it may establish divisions and the number of divisions in the ministry's department (if any) must be specified in the Decree defining the functions, tasks, powers and organizational structure of the ministry.

4. A department shall operate on the basis of headship regime combined with expert regime.

5. Criteria for establishment of a department:

a) The Department is established when the following criteria are fully satisfied:

Having the function and task of advising on the state management of branches and domains within the functions and tasks of such ministry;

Having the scope and subjects of management by industry or field;

The workload requires to arrange 15 or more civil servants.

b) The Department performing the functions and tasks of advising on internal management is established when the workload requires the arrangement of 15 or more civil servants.

What is organizational structure of the Office of a ministry of Vietnam? 

Pursuant to Article 19 of the Decree 123/2016/NĐ-CP (amended by Article 5 of the Decree 92/2017/NĐ-CP and Article 1 of the Decree 101/2020/NĐ-CP) stipulating organizational structure of the Office of a ministry of Vietnam as follows:

1. The Office is an organization that is affiliated to a Ministry, exercises the function of providing advice on working programs and plans and serves activities of the Ministry; assists the Minister in supervising organizations and units affiliated to the Ministry implementing working programs and plans of the Ministry; controls administrative procedures and organizes single-window handling of administrative procedures by central government authorities in accordance with law.

2. The Office shall perform tasks related to administrative, clerical and archival work; control and reform administrative procedures, organize single-window handling of administrative procedures by central government authorities; manage technical infrastructure, assets, operating funding, provide adequate working facilities; serve activities of the ministry and its internal administration; and perform other tasks prescribed by law or assigned by the Minister

3. The office is established in accordance with the criteria for the establishment of the department and the assigned work tasks.

4. The Office has its own seal; the chief of the office may sign administrative documents under the order of the Minister as assigned by the Minister; the chief of the office may sign documents on issues within the office’s competence and append the office’s seal on such documents.
